Terms of Service

1. Introduction

1.1. Who are We?

For users located in the European Union (EU), European Economic Area (EEA), the United Kingdom (UK), or Switzerland, the Services are provided by CoMeety Technology Services Limited. For all other users, the Services are provided by CoMeety App.

1.2. What does this Agreement Cover? 

These Terms govern your access to and use of www.comeety.app (the “Website”), the CoMeety mobile application (the “App”), and any related features, content, or services we make available (collectively, the “Services”).

1.3. Definitions & Parties

As used in this Agreement, the terms “CoMeety,” “we,” “us,” “our,” and the “Company” refer to CoMeety, Inc. and/or CoMeety Technology Services Limited, as appropriate. “You” refers to the individual or entity accessing CoMeety’s Services. Together, you and CoMeety are completely separate “Parties”, and each is an independent “Party” from each other.

Therefore, this Agreement does not create or establish a partnership, joint venture, employment, agency, or fiduciary relationship. You act on your own behalf and are totally responsible for your actions and any content or interactions you undertake through the Services or in connection with activities arranged via these Services. Except where required by law, CoMeety is not responsible for users actions or omissions.

1.4. How do you Agree? 

By creating an account, installing or using the App, visiting the Website, or otherwise accessing the Services, you acknowledge that you have read and agree to be bound by these Terms & Conditions. If you do not agree, you must not access or use our Services.

1.5. What are the Other Documents that Apply?

Our Privacy Policy, Cookie Policy, and Community Guidelines (including any safety recommendations), as well as any additional terms presented when you purchase or enable particular features (collectively, the “Additional Terms”), are incorporated into these Terms. Please review them carefully.

2. Eligibility (Who Can Use Our Services)

2.1. Basic Requirements

You may use the Services only if: 
(a) you are not prohibited by law to use CoMeety Services;
(b) you have not committed, been convicted of, or pled no contest to any offense involving violence, a threat of violence, or sexual misconduct; 
(c) you maintain only one account; and 
(d) you have not previously been removed or suspended from the Services (or our affiliates’ services) unless we have given you an approved permission to create a new account. 

2.2. Age and Capacity

To create an account or use the Services, you must be at least eighteen (18) years old and have the legal capacity to enter into these Terms. The Services are not intended for, and may not be used by, anyone under 18.

2.3. Re-registration after Enforcement

If your account has been suspended or removed for violating these Terms or for unsafe behavior, you may not register again. 

2.4. Jurisdictional Limits

Some features may be unavailable in certain countries due to legal or safety requirements. You are responsible for ensuring that your use of the Services is permitted under the laws of your jurisdiction.

2.5. Sanctions and Export Controls

You may not use the Services if you are located in, or are a resident of, a country or territory subject to comprehensive trade sanctions, or if you are listed on, or controlled by a person listed on, any applicable sanctions or restricted-party list. You agree not to export, re-export, or transfer the Services except as permitted by applicable export-control and sanctions laws.

2.6. Identity Verification and KYC

We may require you to verify your identity (for example, by government-issued ID, selfie, payment-method verification, or similar measures) to access certain features, to receive payouts, or when safety or compliance requires it. If you do not complete required verification, we may limit or deny access to those features.

2.7. Background Checks (where permitted by law)

For roles that involve organizing, hosting, or leading activities, or where safety risks are elevated, we may (but are not obligated to) conduct background checks or screening using lawful providers and public records, subject to applicable law and our Privacy Policy. We may deny or revoke access based on screening outcomes.

2.8. Organizations and Authorized Representatives

If you register or use the Services on behalf of a company, organization, or other entity, you represent that you are authorized to bind that entity to these Terms, and “you” includes that entity. The entity remains responsible for all activity under its accounts.

2.9. Host/Organizer Requirements

If you create or host activities, you represent that you;
(a) meet all legal requirements to do so in your jurisdiction 
(including permits, licenses, and insurance where required), 
(b) will comply with our Community Guidelines and safety recommendations, and 
(c) will provide accurate, non-misleading information about each activity. 

We may require proof of compliance at any time.

2.10. Ban Evasion 

If your access is suspended or terminated, you must not attempt to create or use another account or otherwise access the Services, including by using a different identity, email address, device, payment method, or by acting through another person.

2.11. Accurate information

You represent and warrant that all information you provide to us (including during registration and verification) is true, accurate, and complete, and you agree to keep it current.

2.12. Adult-Only Service by Region

CoMeety is an adult-only service. A person under 18 may not create an account, use the Services, organize or join an activity, or attend an activity through CoMeety, even where local law permits a lower age of digital consent. We may use proportionate age-assurance measures and may suspend or delete an account where we reasonably believe the user is under 18.

2.13. Organizer Competences

For higher-risk activities, including hiking and diving, organizers must hold any qualifications and insurance required by applicable law and provide accurate risk disclosures on the activity page. CoMeety may request reasonable evidence of compliance at any time. You may request proof at any time.

 

3. Account Registration & Security

3.1. Creating an Account

To use the Services you must register for an account either by manual sign-up or by using an approved single sign-on method (e.g., Google, Apple, Meta). If you choose a single sign-on option, you authorize us to receive information from your provider as described in our Privacy Policy.

3.2. Accurate Information and Updates

You agree to provide true, accurate, and complete registration information and to keep it current. We may disable or reclaim usernames that violate these Terms, infringe rights, or are inactive.

3.3. Credentials and Security

You are responsible for keeping your login credentials confidential and for all activity under your account. You must promptly notify us of any suspected unauthorized access or security incident. We may require additional verification (including multi-factor authentication) to protect the Service or your account.

3.4. No Account Sharing or Transfer

You must not share your account or credentials with anyone, permit others to access your account, or transfer your account to another person or entity.

3.5. Identity Integrity

You must not create an account under a false identity, misrepresent your identity or affiliation, impersonate any person or entity, or otherwise mislead users about who you are or your purpose.

3.6. Organization Accounts

If you create or administer an account on behalf of an organization, you represent that you are authorized to do so and you are responsible for managing authorized users and permissions for that account.

3.7. Contact Changes

Changes to your primary email (or phone) may require confirmation via both your old and new contact. We may temporarily restrict sensitive actions on your account after such changes.

3.8. Session Controls

You can review or revoke active sessions and connected devices. We may sign you out of other sessions after a password or security change.

3.9. Strong Authentication

We may require multi-factor authentication or passkeys for certain features or for organizers/hosts and payout recipients.

3.10. Reserved and Verified Names

We may restrict or reclaim community or activity names that imply an affiliation with CoMeety (e.g., “admin,” “comeety”) or that otherwise violate these Terms & Conditions.

3.11. Account Recovery and Disputes 

To resolve account ownership disputes, we may request documentation and will grant or deny recovery in our discretion to protect users and the Service.

3.12. Dormant Accounts

We may deactivate, reclaim, anonymize, or delete accounts that are inactive for an extended period, as described in Account Deletion & Data Retention.

 

4. User Conduct & Acceptable Use

4.1. General Obligations

You must use the Services in compliance with applicable laws, these Terms & Conditions, and our Community Guidelines, acting in good faith towards other users online and during any face-to-face activities. 

4.2. Prohibited Conduct

Without any limitations, you must not:

 

(a) provide false information about your identity, age, or affiliations;

(b) violate any law, regulation, or contractual obligation;

(c) encourage, promote, perform, or incite illegal activity or organization (including, without limitation, gambling, hunting, ponzi organizations, etc.); 

(d) create any safety risks for you and others, including, without limitation joining/participating in any activity with any weaponry or any hazardous material;

(e) coerce any individual or individuals to do anything without individual consent;

(f) promote third-party services or engage in unauthorized commercial activity;

(g) cause harm to any individual or any minor, or disregard another individual’s consent (including any minor, or living creature); including, without limitation, stalking, deception, blackmail, organizing violence or other harmful actions or communities/organizations, and the use, abuse, or promotion of drugs or medical/poisonous substances;

(h) act defamatory or libelously;

(i) share offensive, misleading, disinformative, obscene, violent pornographic content or conduct

(j) behave abusive, insulting, threatening, or discriminatory, or promote or encourage racism, sexism, ageism, any form of discrimination, hatred, or bigotry;

(k) use language, behave, or share imagery that could reasonably be deemed offensive or is likely to harass, embarrass, alarm, manipulate, or annoy other individuals;

(l) perform commercial activities without authorization (including, without limitation, sales, contests, advertising, links to other websites, or premium-rate phone numbers);

(m) conduct political campaign activities or seeks to influence elections using the CoMeety (other than expressing personal opinions);

(n) infringe or misuse any third party’s rights (including, without limitation, individual rights, intellectual-property rights, or privacy rights);

(o) impersonate others or intend to deceive or manipulate any individual (including, without limitation, scams and inauthentic behavior);

(p) demand personal or financial information from other users;

(q) involve in the transmission of “junk” mail or “spam”;

(r) share or upload spyware, adware, viruses, corrupted files, worms, Trojan horses, or any other malicious code or material designed to interrupt, damage, or limit the functionality of—or to disrupt—software, hardware, telecommunications, networks, servers, or other equipment; or that is designed to damage, interfere with, wrongfully intercept, or expropriate any data or personal information (whether from CoMeety or otherwise);

(s) depict individuals unauthorizedly (e.g., minors without parental consent);

(t) use CoMeety as a platform in ways that could harm CoMeety’s reputation or the integrity of its systems;

(u) record or share photography without the consent of the individuals;

 

otherwise your activity/action violates our Community Guidelines, Terms & Conditions, or Privacy Policy.

4.3. F2F (face-to-face) Interactions and Communication

CoMeety facilitates introductions only and is not responsible for monitoring or controlling offline interactions between the users or any others. You accept that face-to-face meetings are at your own risk and should, at minimum, meet in public venues, inform trusted contacts, avoid sharing sensitive data, and end any interaction if you feel unsafe. 

4.4. Consent and Personal Boundaries

Obtain clear, affirmative, and voluntary consent before any physical or intimate conduct; consent can be withdrawn at any time and must be respected immediately. Coercion, manipulation, or persistence after refusal is a material breach and violates CoMeety’s Terms & Conditions and Community Guideline. 

4.5. Reporting and Enforcement

We highly recommend you to contact and report us through ReportHub in case you observe any violation of any material online or face-to-face mentioned in any agreement and Community Guide by any user and explain in detail for further guidance and support. 

Our vision is to provide a secure platform for everyone to achieve common purposes and will not tolerate any illegal or inappropriate activity, discrimination, and human rights violation. 

4.6. F2F (face-to-face) Harm 

We may take immediate legal actions where lawful and appropriate, notify relevant authorities based on credible information about face-to-face behavior that creates a safety risk to users or the public (e.g., organizing violence, stalking, or harassment).

4.7. Organizer Terms & Conditions

Payments & Solicitation: Until CoMeety expressly activates paid-service or activity-payment features, users must not collect mandatory participation fees through CoMeety or represent that CoMeety processes or guarantees a payment. Unauthorized off-platform solicitation, investment opportunities, pyramid schemes, and advance-fee schemes are prohibited. Once payment features are activated, payments must comply with §9.8 and any Additional Terms shown before purchase.

5. Changes to Terms & Services

5.1. Updates to the Terms & Conditions

Our Terms & Conditions are subject to change. When there is a change, we will publish the updated Terms & Conditions with reasonable timing and may also notify you by email, in-app notice, or other effective means. Unless a longer period is required, changes take effect no sooner than 14 days after notice. 

 

To the extent permitted by law, your continued use of the Services after the effective date constitutes your acceptance of the updated Terms & Conditions. Material changes to our Limitation of Liability or Dispute Resolution provisions will require your affirmative acceptance.

5.2. Changes to the Services 

We may add, modify, suspend, or discontinue any feature or component of the Services (including security or safety features, subscription plans, pricing, and availability) at any time. Where required by law or where changes materially and adversely affect paid features, we will provide reasonable advance notice.

5.3. Price and Plan Changes

No paid plan or activity-payment obligation applies unless CoMeety has expressly activated the relevant feature and presented the total price, billing terms, cancellation information, and any Additional Terms before purchase. Once activated, we may change prices, billing cycles, or plan features only with the notice and choices required by applicable law and §9.8. If you do not agree to a future change, you may cancel before it takes effect.

5.4. Feature Deprecation and Sunsets

CoMeety reserves all the rights to deprecate or sunset features that are no longer viable for technical, security, monetary or legal reasons. We will make reasonable efforts to provide migration paths or alternatives where feasible.

5.5. Your Choices

If you do not agree to updated Terms or material Service changes, you must stop using the Services and, if applicable, cancel any paid plan before the effective date.

5.6. What counts as a “Material Change”

A change is “material” if it: 

(a) meaningfully reduces core functionality of paid features, 
(b) increases your price or materially alters billing terms, 
(c) narrows your rights or expands our rights in a way adverse to you (including Dispute Resolution or Limitation of Liability), or 
(d) changes how we process your personal data beyond what is described in the Privacy Policy. 

Material changes require affirmative acceptance where required by law.

5.7. Regulatory & Safety Exceptions (Force Update)

Changes made to comply with law, address security issues, or prevent abuse may take effect immediately upon publishing and notice. 

We may force the user to update the App, if there is a vital change or legal obligations.

5.8. Beta/Preview Features

We may offer features labeled Beta, Preview, or similar. These are provided as-is, may be limited or discontinued at any time, may not meet normal reliability or compliance commitments, and may be subject to additional terms. Feedback you provide may be used to improve the Services.

5.9. Order of Precedence

If Additional Terms apply to a specific feature and conflict with these Terms, the Additional Terms control for that feature.

5.10. No Retroactive Effect for Disputes

Changes to Dispute Resolution do not apply to disputes of which we had actual notice before the change took effect. You retain any opt-out rights stated in that section.

6. Content & Intellectual Property

6.1. Your Content

You retain ownership of content you create, upload, post, or otherwise make available through the Services (“User Content”).

6.2. License you Grant to CoMeety

To operate, improve, and promote the Services, you grant CoMeety a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, use, reproduce, modify, adapt, publish, translate, create derivative works, distribute, publicly perform, and publicly display your User Content in connection with the Services and CoMeety’s marketing and communications. To the extent permitted by law, you waive any moral rights you may have in User Content for these limited purposes.

The license exists only so we can operate, secure, improve, and promote the Services. It continues while your User Content is on the Services and survives removal solely for;
(a) technical backups kept for a limited period, 
(b) compliance with law or valid legal process, 
(c) resolution of disputes or enforcement, and 
(d) continued display where your Content has been re-shared by other users (until they remove it).

6.3. Your Warranty

You represent and warrant that you have all rights necessary to grant the above license; that your User Content is accurate and lawful; and posting it does not infringe or misuse any third party’s rights, including privacy, publicity, and intellectual-property rights.

6.4. Feedback Cycles

If you submit ideas, suggestions, or feedback, you grant CoMeety a perpetual, irrevocable, worldwide, royalty-free license to use and utilize that feedback without restriction or compensation.

Feedback given by users for the improvement of CoMeety are evaluated as intellectual property of CoMeety and all rights are reserved by CoMeety.

6.5. CoMeety Licences and Property Rights

The Services and all materials provided by CoMeety (including software, designs, logos, trademarks, mascot and content) are owned by CoMeety or its licensors and are protected by intellectual-property laws. Except for the rights expressly granted to you, CoMeety and its licensors reserve all rights.

6.6. Copyright, DMCA & EEA Intellectual-Property Notices

CoMeety respects intellectual-property rights and will respond to sufficiently precise and substantiated notices of alleged infringement under applicable law, including applicable EU/EEA copyright law, the Digital Services Act notice-and-action framework, and, where applicable, the United States Digital Millennium Copyright Act (DMCA).

 

A copyright or intellectual-property notice should include:

(a) a physical or electronic signature of the rights holder or an authorized representative;

(b) identification of the protected work, or a representative list where multiple works are involved;

(c) identification and the exact location of the allegedly infringing material, including the relevant URL, activity, community, account, or post;

(d) the notifier’s name and reliable contact details;

(e) a statement that the notifier has a good-faith belief that the disputed use is not authorized by the rights holder, its agent, or the law; and

(f) a statement that the information is accurate and that the notifier is the rights holder or is authorized to act on the rights holder’s behalf, and, where the DMCA applies, that the statement is made under penalty of perjury.

 

Notices may be submitted through support@comeety.app using the contact details in §16.1. CoMeety may request missing information, remove or restrict access to material, preserve relevant records, and notify the affected user. We may terminate accounts of repeat infringers in appropriate circumstances.

 

Personal data contained in a notice is processed only as necessary to assess and resolve the claim, comply with legal obligations, establish or defend legal claims, prevent abuse, and communicate with affected parties. We apply data minimization, disclose personal data only where necessary and lawful, and retain notice records in accordance with §8.6 and §17.12.

6.7. Pre-Screening

We generally do not pre-screen User Content but may monitor, review, remove, or restrict content at our discretion, consistent with these Terms.

6.8. Public vs. Private Areas 

Content you publish, activities or communities you created to public areas (including public activity pages) may be visible to anyone and may be indexed by search engines. Content in private areas is shared only as configured by you and participants, subject to our Privacy Policy and safety obligations.

6.9. License to Other Users

For Content published to areas where other users may view or reuse it (e.g., activity descriptions, community publications), you grant those users a limited license to access and use that Content within the Services as intended (e.g., viewing, quoting in replies, saving to event pages). This license ends when the Content is removed, except where users already relied on or re-shared it.

6.10. No Confidential Information Sharing 

The Services are not designed as a repository for confidential information. Do not upload Content you consider confidential or that you are not authorized to share.

6.11. Technical Processing & Transformations

You authorize us to transcode, compress, reformat, analyze, and scan User Content (including for malware/safety, spam detection, metrics, and content delivery) to operate and protect the Services.

6.12. Takedowns & Counter-Notices

If your Content is removed or restricted because of an intellectual-property notice and you believe the action was based on mistake or misidentification, you may submit a counter-notice through ReportHub or to support@comeety.app.

 

A counter-notice should include:

(a) your physical or electronic signature;

(b) identification of the material and its location before removal or restriction;

(c) a statement of your good-faith belief that the material was removed or restricted because of mistake or misidentification;

(d) your name and reliable contact details; and

(e) where the DMCA applies, the legally required consent to jurisdiction and acceptance of service of process.

 

We may forward a valid counter-notice to the original notifier. Where the DMCA applies, we may restore the material within the legally applicable period unless the notifier informs us that court proceedings have been filed. In other jurisdictions, restoration or continued restriction will be handled under the applicable law and our complaint procedures. Personal data in counter-notices is processed and retained as described in §6.6, §8.6, and §17.

6.13. Trademarks & Brand Use

You may not use CoMeety’s trademarks, logos, or brand assets without prior written permission, except as necessary to reference the Services or truthfully identify your account or activity.

6.14. Organizer Media & Recording

If you record or photograph an activity, you must disclose this in the activity description and obtain any required consents. You are responsible for securing permissions and complying with privacy, publicity, and child-protection laws.

6.15. Synthetic/AI-Generated Media

AI-generated or materially manipulated audio, image, video, or text must comply with applicable law. Where content constitutes a deepfake or is generated or manipulated for the purpose of informing the public on matters of public interest, you must provide a clear, visible, and timely disclosure whenever legally required. For artistic, satirical, fictional, or analogous works, an appropriate disclosure may be used in a manner that does not unreasonably hinder the display or enjoyment of the work. You must not use synthetic media to impersonate, defraud, harass, or falsely depict a real person or activity.

6.16. Model & Feature Improvement

We may use aggregated information and information that has been genuinely anonymized so that it is no longer reasonably linkable to an individual to improve safety, performance, and features. Encrypted or pseudonymized information is not treated as anonymous where it can still be linked to a person. Any use of identifiable User Content or personal data for AI-model or feature improvement will require an applicable legal basis, appropriate transparency, safeguards, and any consent or choice required by law. We do not sell personal data.

6.17. Third-party Materials & Open Source

The Services may include third-party content or open-source components subject to their own terms. Those terms govern the third-party materials to the extent of any conflict.

6.18. Name, likeness, and Testimonials

You grant us permission to use your name, display name, avatar, and likeness as they appear in the Services to identify you as the author of your User Content and in product marketing that references public posts or public events. You can opt out of marketing uses via the methods described in Contact; product-interface uses are required to operate the Services.

7. Suspension, Termination & Enforcement

 

Applies to all measures below: We may act at our reasonable discretion and as permitted by law.

7.1. Grounds

Enforcement may occur because of;

(a) breach of these Terms/Guidelines or law,

(b) safety, security, legal, financial, or reputational risk,

(c) fraud, misrepresentation, inauthentic behavior,

(d) integrity/security interference or unauthorized access,

(e) repeated, credible harm reports,

(f) evasion of prior enforcement,

and any other legal/regulatory requirements. 

7.2. Enforcement Measures - “Sanctions”

We may apply:

(a) Content: removal, restriction, warning/labels, reduced discoverability;

(b) Features: temporary/permanent limits on messaging, posting, invites, groups, hosting, payouts;

(c) Accounts: warnings/strikes, suspensions, verification, host-privilege revocation, termination;

(d) Technical: session kill, forced reset, MFA, device/network/IP blocks, rate limits, geo-restrict;

(e) Financial: payout holds/reversals, chargeback holds (per law/policy);

(f)  Ecosystem: de-recommendation, event de-listing, badge removal, associated-account restrictions;

(g) Third parties: limited sharing with payment/hosting/security providers where necessary and lawful.

7.3. Emergency Action

CoMeety is authorized to take immediate action (incl. termination/content removal without prior notice) to prevent/mitigate imminent harm, abuse, fraud, integrity threats, or to meet urgent legal duties.

7.4. Notice

For significant content, feature, account, or monetization restrictions, we will provide a clear statement of reasons where required by law, including the facts and contractual or legal grounds relied upon, information on any automated means materially used, and available complaint or redress options. We may withhold or limit notice where disclosure is prohibited by law, would create a serious risk of harm or evasion, or would compromise an investigation.

7.5. Appeals

You may appeal an eligible moderation or enforcement decision through ReportHub or support@comeety.app. Where Article 20 of the EU Digital Services Act applies, the complaint system will be electronic, free of charge, easy to access, available for at least six (6) months from notification of the decision, and handled under the supervision of appropriately qualified personnel rather than solely by automated means. For other eligible enforcement decisions, an appeal may be submitted within 30 days unless a longer period is required by law. We may request relevant information, and proportionate restrictions may remain in effect during review.

7.6. Errors & Reinstatement

If action was in error, we’ll reverse/narrow it and restore where feasible. Fees are non-refundable unless required by law; discretionary credits may be offered.

7.7. Evidence

Unless law requires, we do not disclose internal signals, methods, reporter identities, or detailed evidence; summaries may be provided where appropriate. However, if law enforces, CoMeety will immediately deliver the entire evidence to the relevant legal institutions for cooperation.

7.8. Preservation 

We may preserve data or Content in accordance with §8.6 and §17.12 to handle appeals, prevent evasion, comply with law or legal holds, and protect users and the Services.

7.9. Repeat-infringer & strikes

We maintain a repeat-infringer policy for intellectual-property violations and a strike system for serious or repeated breaches. See §§6.6 and 6.12 and the Community Guidelines.

7.10. Evasion

Creating/using new accounts, devices, payment methods, or intermediaries—or acting through others—to bypass enforcement is a separate violation and may trigger broader technical blocks.

7.11. Misuse of Safety Tools

Malicious/coordinated reporting, appeals abuse, or brigading is prohibited and enforceable.

7.12. Subscriptions, Payouts & Balances

This clause applies only after CoMeety activates paid features under §9.8. Enforcement may restrict access to paid features, organizer tools, balances, or payouts. Holds, reversals, refunds, and chargeback measures must be proportionate, consistent with the applicable payment terms and consumer law, and limited to what is reasonably necessary for fraud, safety, legal, or contractual compliance.

7.13. Monitoring

There is no general duty of CoMeety to monitor the user actions/activities but we may act based on the reports, automated systems, trusted signals, or our own review, and may decline incomplete/abusive reports.

7.14. Reservation of Rights

Practices may evolve; we apply measures case-by-case (context, severity, history, region). Non-action once is not a waiver.

7.15. Regional Terms

Additional notice, complaint, disclosure, and redress rights may apply under Regional Terms and mandatory law.

 

For recipients of the Services in the EU/EEA, and to the extent the Digital Services Act applies:

(a) notices of alleged illegal content may be submitted through the notice-and-action mechanism in accordance with DSA Article 16;

(b) CoMeety will provide statements of reasons for covered restrictions in accordance with DSA Article 17;

(c) eligible decisions may be challenged through the internal complaint-handling system for at least six months in accordance with DSA Article 20;

(d) eligible recipients may select a certified out-of-court dispute-settlement body in accordance with DSA Article 21, without prejudice to the right to bring court proceedings at any stage; and

(e) moderation and complaint decisions will be handled diligently, objectively, proportionately, and with human supervision where required.

 

CoMeety may publish transparency information required by applicable law, including aggregated information about notices, moderation actions, complaints, reversals, and the use of automated moderation tools.

 

Law-enforcement cooperation is limited to valid legal processes and emergency disclosures permitted by law. Personal data is shared only where necessary, proportionate, and lawful.

 

Terminated users may request an export of their lawful personal data, subject to the Privacy Policy, the rights of others, technical limitations, and lawful preservation requirements.

8. Account Deletion & Data Retention

8.1. Your Right to Delete

You may request deletion of your account at any time through CoMeety settings or ReportHub. The account will be deactivated and removed from public view promptly, subject to the reactivation period and lawful retention described below.

8.2. Processing of Deletion

When you request deletion:

(a) the account is deactivated promptly;

(b) a 30-day reactivation period begins;

(c) after that period, production-system deletion or anonymization is normally completed within a further 30 days; and

(d) limited information may be retained only where necessary for legal obligations, security, fraud prevention, enforcement, dispute resolution, or the establishment, exercise, or defense of legal claims.

8.3. Reactivation Window

You may reactivate your account within 30 days after requesting deletion. After the reactivation period expires and deletion processing begins, restoration may be impossible.

8.4. Residual Data

Residual copies may remain temporarily in access-restricted backups, security logs, and disaster-recovery systems until the applicable deletion cycle is completed. Such data is not returned to ordinary use unless restoration is required for security or continuity purposes.

8.5. Content Shared with Others

Content that has been shared with other users, quoted, incorporated into a community or activity, or retained as part of another user’s lawful records may remain where deletion would impair the rights of others, the integrity of a conversation or activity, or a legal obligation. Where reasonably possible, CoMeety will remove or detach your account identifiers within 30 days after final account deletion. Deletion does not transfer or extinguish your intellectual-property ownership.

8.6. Legal and Legitimate Retention Schedule

CoMeety applies the following default maximum periods, unless a shorter period is sufficient or a longer period is required by Union or Member State law, a legal hold, or the establishment, exercise, or defense of legal claims:

(a) Account and profile data: for the active account period, the 30-day reactivation period, and up to 30 additional days for production-system deletion; minimal account-closure and ban-evasion records may be retained for up to 24 months;

(b) User Content: until deleted by the user or final account deletion, subject to §8.5 and lawful preservation requirements;

(c) Safety and moderation records: ordinarily 24 months after closure; records relating to serious safety incidents, repeat violations, fraud, or permanent enforcement may be retained for up to 5 years where necessary and proportionate;

(d) Security and fraud-prevention logs: ordinarily 12 months and up to 24 months where linked to an active investigation or demonstrated security need;

(e) Support communications and consent records: ordinarily 24 months after closure of the request; records needed to demonstrate consent or withdrawal may be retained for up to 3 years after the relevant processing ends;

(f) Precise location data: processed ephemerally where possible and retained for no longer than 30 days unless saved by the user as part of an activity, required for a safety incident, or required by law; aggregated or genuinely anonymized location statistics may be retained longer;

(g) Analytics and device logs: ordinarily up to 12 months, after which they are deleted, aggregated, or genuinely anonymized;

(h) Payment, invoice, tax, payout, and transaction records, once paid services are activated: for the statutory period required by the applicable EEA country, ordinarily 7 to 10 years;

(i) Intellectual-property notices and counter-notices: ordinarily 3 years after closure, or longer where a dispute or legal claim remains pending;

(j) Backups: overwritten or deleted on a rolling cycle not exceeding 90 days; and

(k) Legal holds and claims: for the duration of the hold, investigation, proceeding, or applicable limitation period, plus a reasonable period for closure.

8.7. Purpose Limitation

Retained personal data will be used only for the purpose that justified retention and will not be used for an incompatible new purpose.

8.8. Data Portability and Access

You may request access to or portability of eligible personal data before deletion is completed. Requests are subject to applicable law, the rights of other persons, and reasonable identity verification. CoMeety is not required to recreate data that has already been lawfully deleted or anonymized.

8.9. Suspension, Investigation, or Termination

Where an account is under investigation, suspended, or terminated under §7, deletion of relevant data may be delayed only to the extent and for the period necessary to investigate, handle an appeal, prevent evasion, comply with law, or establish, exercise, or defend legal claims. Unrelated data remains subject to the ordinary deletion schedule.

8.10. Backups and Anonymization

Backup copies are access-restricted and removed through the rolling cycle in §8.6. Data that has been genuinely anonymized so that it is no longer reasonably linkable to a person may be retained for statistics, research, security measurement, and service improvement.

8.11. Conflicts with Law

Where mandatory law requires a different retention or deletion period, that law prevails. Further information is provided in the Privacy Policy and §17.

9. Activities & Communities

9.1. Overview

CoMeety provides a digital platform and technical tools through which users may create, host, discover, and join activities and communities. Unless CoMeety expressly states otherwise for a specific feature or transaction, CoMeety is not the organizer, venue, employer, insurer, or party to an agreement between users, and does not supervise participants or venues. If paid tools are activated, CoMeety’s role for the relevant transaction will be disclosed before payment in accordance with §9.8. Attendance and participation remain subject to these Terms, the Community Guidelines, and the safety responsibilities stated in this Section.

9.2. Organizer & Host Terms

(a) Legal Compliance

Organizers must comply with all applicable laws, including required permits, licenses, insurance, taxes, and venue regulations. Organizers should also provide reasonable accommodations and accessibility information in accordance with applicable accessibility or equality laws. CoMeety may verify these information in terms of activity authenticity and organizer identity, but such verification is still not a guarantee of safety or compliance.

 

(b) Accuracy & Transparency

All activity and community listings must be truthful and complete; clearly stating purposes, public-access, contents, requirements, locations, costs, accessibility, risks, and whether recording or photography will occur.

 

(c) Safety Duties

Organizers must assess and mitigate foreseeable risks, provide safety instructions, and ensure the activity is suitable for the (potential) participants.

 

(d) Professional & Business Disclosure

Organizers operating as businesses or professionals must identify themselves as such and comply with consumer-protection laws (e.g., EU “trader” rules).

 

(e) Communications & Data

Participant information may be used only for legitimate activity operations and must not be sold, shared, or marketed without lawful consent proof.

 

(g) Insurance & Coverage

CoMeety does not provide insurance. Organizers are responsible for obtaining public liability or event insurance as required by law.

9.3. Safety Center & Risk Awareness

(a) Personal Responsibility

CoMeety cannot monitor every user or venue. Participants should exercise caution: meet in public venues, inform trusted contacts, verify activity details, and leave any situation that feels unsafe.

 

(b) Health & Fitness

You are responsible for your own physical and mental readiness and health to participate in an activity or community. CoMeety disclaims any responsibility for physical or mental harm that may occur.

For wellness or physical activities (yoga, exercise, therapy, etc.), please note that CoMeety is not a medical provider nor a consultant, and participants should seek professional advice before engaging in such activities.

 

(c) Risk Disclosure

Organizers must disclose material risks (e.g., terrain, weather, physical exertion) and confirm that participants meet stated prerequisites and refuse the participation of users who do not maintain prerequisites.

 

(d) Emergency Response

It is expected from you to report any violation of Terms & Conditions by any other user or community to CoMeety via ReportHub. However, CoMeety is not a substitute for emergency services. In emergencies, contact local authorities to get instant support. 

 

(e) Alcohol, Drugs & Controlled Substances

Activities involving alcohol must comply with legal age limits. The possession or use of illegal or dangerous substances is strictly prohibited.

 

(f) Reporting & Moderation

Incidents, unsafe conduct, or suspected violations (even stands potentially) should be reported via ReportHub or email to support@comeety.app in §16.6. CoMeety may remove or modify activities that pose risk or violate law or policy.

9.4. Adult-Only Activities & Vulnerable Persons Safeguarding

(a) Adult-Only Creation and Hosting

Activities and communities offered through CoMeety may be created or hosted through the Services only by persons aged eighteen (18) or older.

 

(b) Parental Guardian

Minors may join or attend activities only together with verified parental or guardian and if the activity is marked as Kids-Friendly. Minors can not attend to any activity individually still even if there is proven parental consent.

 

(c) Vulnerable Adults

Any exploitative, coercive, abusive, discriminatory, or endangering behavior toward a vulnerable adult may result in immediate enforcement and, where required or appropriate, referral to competent (legal) authorities.

 

(d) Reporting and Lawful Cooperation

CoMeety may take proportionate safety measures and comply with applicable safeguarding and reporting obligations. Immediate danger must be reported to local emergency services.

9.5. Event Media & Recordings

(a) Disclosure
Organizers must announce any planned recording or photography in advance.

(b) Consent

Participants may refuse to be recorded where feasible. Organizers must comply with privacy and publicity laws. Organizers must obtain parental consent before photographing or recording minors.

(c) Ownership

Media recorded by organizers remains their responsibility and must not violate any individual’s rights.

9.6. Assumption of Risk & Release

By joining or participating in communities or activities, you voluntarily assume all risks associated with those communities and activities, including legal responsibility, injury, illness, loss, or damage, except where prohibited by law. To the extent permitted, you release CoMeety and its affiliates from any related claims or liabilities.

9.7. Prohibited Activity and Communities

In addition to the restricted items and activities detailed in Section 4.2 (whether engaged in individually or in combination), the following activities and communities are strictly prohibited:

 

Hate and Discrimination: Any behavior, content, or community that promotes, facilitates, or engages in disrespect, discrimination, harassment, or hatred against individuals or groups.

 

Dangerous Items and Materials: The promotion, facilitation, or distribution of weapons, ammunition, venomous or poisonous substances, or other inherently dangerous items, including any instructional guides or manuals related to them.

 

Harmful Content: Any content, context, or activity that causes, encourages, or depicts physical, psychological, or emotional harm to any living being.

 

Unlicensed Medical and Therapeutic Advice: The provision of unlicensed therapy, unauthorized medical applications, or unregulated medical and health-related guidance directed at any living being.

 

Adult Services: The offering, promotion, or facilitation of sexually explicit content, pornography, or any form of adult-oriented services.

9.8. Future Paid Services, Subscriptions & Activity Payments

This Section is preparatory and applies only when CoMeety expressly activates a paid feature, subscription, ticket, organizer payout, or activity-payment function. No user is charged merely because these Terms contain this Section.

 

(a) Pre-Contract Information and Acceptance

Before a purchase, CoMeety will display the total price, currency, taxes or fees, the identity and role of the relevant trader or organizer, the main features, duration, renewal terms, cancellation method, refund conditions, and any applicable Additional Terms. Payment requires an affirmative action indicating agreement.

 

(b) Subscriptions and Trials

A recurring subscription will renew only where the user has clearly agreed to recurring billing. The renewal frequency and price will be disclosed before purchase. Users may cancel through an accessible method, and cancellation will normally take effect at the end of the paid billing period unless mandatory law provides otherwise. Trial conversion and reminder notices will be provided where required by law.

 

(c) EEA Withdrawal and Statutory Remedies

EEA consumers retain any mandatory withdrawal, conformity, refund, price-reduction, termination, and other statutory rights. Where immediate supply of digital content or a digital service may affect a withdrawal right, CoMeety will obtain any express request, consent, acknowledgment, and confirmation required by law before performance begins.

 

(d) Paid Activities, Cancellations, and Refunds

For a paid activity, the listing or checkout will identify the organizer, the price, cancellation and refund policy, material restrictions, and whether CoMeety acts as a technical intermediary or in another disclosed capacity. Unless expressly stated otherwise, the organizer remains responsible for delivering the activity and complying with trader, tax, licensing, insurance, safety, and consumer-protection obligations.

 

(e) Payment Providers, Verification, and Payouts

Payments may be processed by authorized third-party payment providers under their terms and privacy notices. Organizers may be required to complete identity, tax, sanctions, anti-fraud, or payout verification. CoMeety or its payment provider may delay, hold, reverse, or refuse a transaction or payout where reasonably necessary for fraud prevention, chargebacks, refunds, sanctions, legal obligations, or enforcement.

 

(f) App-Store Purchases

Purchases made through Apple, Google, or another app-store platform may also be governed by that platform’s billing, cancellation, and refund rules. Mandatory consumer rights remain unaffected.

 

(g) Taxes and Records

Users and organizers are responsible for taxes imposed on their own income or activities, except for taxes CoMeety is legally required to collect, withhold, report, or remit. Transaction records will be retained in accordance with §8.6.

 

(h) Future Additional Terms

CoMeety may publish separate Payment Terms, Subscription Terms, Organizer Payout Terms, or Paid Activity Terms before the relevant feature is activated. Those Additional Terms will control only for the paid feature to which they apply and will not apply retroactively to a completed transaction.

10. Third-Party Services, Integrations & Links

10.1. Third-party Integrations

The Services may link to or integrate with third-party products, websites, or applications (including sign-in providers, payment processors, mapping or ticketing tools, or messaging platforms).

These third-party services are governed by their own Terms and Privacy Policies, and CoMeety is not responsible for their availability, security, or performance. Therefore, we strongly suggest you to use them at your discretion. Furthermore, CoMeety is not responsible for acts or omissions of third-party providers, including any damage, data loss, or breach resulting from their systems.

10.2. Single Sign-On (SSO) & App-Store Platforms

If you register or log in through Apple, Google or Meta, CoMeety receives only the information these providers make available (e.g., verified email, name, or ID token). Your relationship with those providers is governed by their terms.

10.3. External Content & Links

Links, advertisements, or user-shared URLs do not imply endorsement by CoMeety, nor is CoMeety property. We may remove or block links we believe to be unsafe, misleading, or unlawful.

10.4. APIs & Developer Access

If you use CoMeety’s APIs, SDKs, or other integration tools, you must comply with our Developer Terms and may not scrape, resell, or misuse data. We may throttle or revoke API access at any time for security or abuse reasons.

 

Integrations and API’s may vary by region or version and can be modified or removed at any time for legal, technical, or business reasons.

10.5. Data Sharing with 3. (Third) Party

We share limited information with service providers to deliver functionality—such as hosting, payments, analytics, maps, and safety systems—under strict data-processing agreements consistent with our Privacy Policy.

10.6. Geo-Location & Background Location Permissions

(a) Permission & Control

Certain features (e.g., nearby events, navigation, safety tools) require location access. You control this through device settings and may revoke it anytime.

 

(b) Types of Location Use

Foreground: Used while the app is open for recommendations, event proximity, or directions.

Background: If enabled, used for safety check-ins or travel reminders even when the CoMeety as an App is not active.

 

(c) Accuracy & Limits

Location data may be inaccurate, unavailable, or delayed due to device, network, or environmental factors; it must not be relied upon for emergency purposes. Please report such issues if you encounter such errors or unexpected cases by using support@comeety.app.

 

(d) Data Retention

Real-time location is processed ephemerally; only short-term logs (≤24 h) are retained for security or fraud prevention. Aggregated, anonymized location data may be kept for analytics (see §8).

 

(e) Consent to Use

By enabling location features, you consent to CoMeety’s processing of that data solely for the stated purposes, in accordance with the Privacy Policy.

10.7. Push Notifications & Communication Preferences

(a) Transactional Communications

We may send essential notices—security alerts, account updates, tickets, and activity and community updates & reminders—by email, in-app messages, or push notifications.

 

(b) Marketing Communications

Promotional or marketing content is sent only with your opt-in consent where required by law. You may withdraw consent at any time via Settings or unsubscribe links.

 

(c) SMS / WhatsApp / Calls 

If you provide a phone number, you consent to receive service-related messages; standard carrier rates may apply. Opt out as described in each message.

 

(d) Preference Management

You may adjust communication preferences in your account settings. Disabling push notifications may limit awareness of updates or event changes.

 

(e) Security of Communications

While we take reasonable safeguards, electronic communications may be subject to delays or interception beyond our control; but we will cooperate reasonably to restore access or functionality as much as possible but can not guarantee fixes immediately.

10.8. No Liability for External Systems

CoMeety is not responsible for errors, downtime, or data loss caused by third-party integrations, network providers, or app-store systems, but will cooperate reasonably to restore access or functionality where possible.

10.9. Changes to Integrations

We may update, suspend, or discontinue integrations and related features with reasonable notice where required. Continued use after the effective date constitutes acceptance only to the extent permitted by law.

Personal data transferred to third-party processors outside the EEA is handled in accordance with §17.7, including the use of adequacy decisions, Standard Contractual Clauses, or other lawful safeguards where required.

11. Platform Availability, Maintenance & Beta Features

11.1. Service Availability

CoMeety strives to keep the Services available, secure, and reliable, but we do not guarantee uninterrupted or error-free operation. The platform may occasionally experience downtime for maintenance, security updates, or other technical reasons.

11.2. Maintenance & Updates

We may perform maintenance, improvements, or updates that temporarily affect access. Where feasible, we will provide prior notice through the platform or status channels. Emergency maintenance may occur without notice to protect users or systems.

 

We strongly suggest you check the app-store and update CoMeety with the latest version if you start to experience instant errors, since OS versions may lose compatibility after updates.

11.3. Planned Downtime

Scheduled maintenance windows are designed to minimize disruption. Certain non-critical features may be suspended or degraded during these periods.

11.4. Changes & Feature Management

We may add, modify, suspend, or retire features at any time for technical, operational, or legal reasons. When a change materially affects your paid features, we will give reasonable advance notice and, if applicable, migration or export options.

11.5. Beta & Experimental Features

Features labeled “Beta,” “Preview,” or similar are offered as-is, may be unstable, and can be modified or withdrawn at any time. By enabling Beta features, you acknowledge and accept their experimental nature and inherent instability. They may not meet standard reliability, performance, or compliance levels. Your valuable feedback may be utilized to improve these features.

11.6. Performance & Compatibility

Device, OS, browser, or network performance may affect service quality. Here, the user is responsible for maintaining compatible equipment, updated software, and secure network connections.

11.7. Third-Party Integrations 

Some downtime may stem from hosting or infrastructure partners (e.g., AWS, Google Cloud) beyond CoMeety’s direct control. In such cases, some features of CoMeety may temporarily slow down or not work.

11.8. Data Protection during Maintenance

Routine updates are designed not to affect your stored data. However, you should maintain your own backups of any critical content or exports, as temporary service interruptions or rare data loss may occur. In such errors or unexpected cases CoMeety does not guarantee immediate restoration or data revival. We also strongly recommend you to regularly export important data to avoid dependency risks.

11.9. Platform Suspension for Compliance or Safety

We may suspend or limit service access where necessary to comply with law, court orders, or protect the integrity of the system and its users. Such actions are governed by §7.

11.10. No Service-Level Guarantee

No Service-Level Agreement (SLA) applies unless otherwise agreed in writing.

11.11. Business Continuity

In the event of a serious outage or force-majeure event, CoMeety will take reasonable steps to restore services as soon as possible, prioritizing data preservation and user safety. However, CoMeety does not guarantee instant revival of data.

11.12. Regional Differences

Availability, performance, or feature sets may vary by country due to regulatory, network, or infrastructure factors.

12. Disclaimers

12.1. “As Is” and “As Available”

The Services, including all features, content, user profiles, activities, events, and integrations, are provided “as is” and “as available” without any warranties of any kind. CoMeety disclaims all warranties, express or implied, including those of merchantability, fitness for a particular purpose, accuracy, title, non-infringement, quiet enjoyment, or any arising by statute, usage, or course of dealing.

 

We do not guarantee that:

 

The Services will be uninterrupted, error-free, or secure;

 

Defects or errors will be corrected immediately;

 

Any information, map, recommendation, or event displayed on CoMeety will be accurate, complete, or reliable;

 

The platform will meet your specific expectations or perform in combination with any hardware or software; or

 

Activities, organizers, or users will comply with stated qualifications or descriptions.

12.2. User-Generated and Third-Party Content

The Services host User Content and links to third-party materials (including event pages, messages, websites, media, and integrations). CoMeety does not endorse, control, or verify any such content, nor do we guarantee its legality, truthfulness, or safety. Your interactions with other users, organizers, or third-party platforms are solely between you and those parties.

 

You acknowledge that:

 

CoMeety does not pre-screen all User Content;

 

Content, listings, or recommendations may be inaccurate, outdated, or misleading;

 

Third-party platforms (e.g., payment processors, mapping services, SSO providers) are governed by their own terms and privacy policies; and

 

CoMeety is not responsible or liable for any third-party’s acts, omissions, or system failures.

12.3. Activities and Interactions (digital or face-to-face)

You acknowledge that participating or organizing activities involves inherent risks, including personal injury, property damage, illness, or loss. By joining, organizing, or hosting any event through CoMeety, you:

 

Voluntarily assume all risks, known or unknown, associated with participation;

 

Accept full responsibility for your own conduct and decisions; and

 

Agree that CoMeety is not responsible for supervising, monitoring, or ensuring safety or legality of any activity, venue, or participant. 

 

CoMeety does not provide emergency response or medical services and does not certify organizer competence or venue safety. In an emergency, contact local authorities.

12.4. Platform Recommendations, Discovery & AI Features

Any recommendations, matches, activity suggestions, summaries, or other outputs generated by CoMeety’s algorithms or AI systems are informational only. They are not professional, medical, legal, financial, or psychological advice.

 

Where an AI system interacts directly with you, CoMeety will inform you that you are interacting with AI unless this is obvious from the context to a reasonably informed user. AI-generated or automated outputs may contain inaccuracies, omissions, bias, or unintended interpretations, and you remain responsible for evaluating them.

 

Where required by law, CoMeety will provide meaningful information about the use of automated systems, apply appropriate labels or technical markings to AI-generated content, and make human review available for decisions that materially affect your rights or access to the Services.

12.5. Organizer and Professional Disclaimers

Unless expressly stated, organizers are not employees, agents, or representatives of CoMeety. They act independently and are solely responsible for their conduct, qualifications, and compliance with applicable law.

 

CoMeety does not endorse or guarantee any organizer, service, or activity.

 

Organizers are responsible for maintaining required permits, insurance, and certifications.

 

Users should verify activity legitimacy and organizer credentials before attending and during participation.

12.6. No Emergency or Crisis Services

The Services are not a substitute for contacting emergency, mental health, or crisis resources. If you or anyone is in immediate danger, call local emergency services. CoMeety may provide links to support lines, but does not monitor, triage, or provide crisis intervention.

12.7. No Legal, Medical, or Professional Advice

CoMeety does not provide legal, therapeutic, medical, financial, or professional advice. Information or content on the platform—including activity listings, community discussions, or AI-generated text—should not be considered professional guidance. Always cross-check with reliable sources and seek advice from qualified professionals before acting.

12.8. Limitation of Warranties by Region

Some jurisdictions (e.g., EU/EEA, UK, certain U.S. states) do not allow disclaimers of implied warranties or limitations on consumer rights. In such regions, the above disclaimers apply only to the fullest extent permitted by law, and you retain all mandatory statutory rights.

12.9. Platform Downtime & Force Majeure

CoMeety is not responsible for interruptions, delays, or data loss caused by events beyond its reasonable control, including natural disasters, government actions, cyberattacks, strikes, or failures of networks, servers, or third-party infrastructure providers.

12.10. No Service-Level Guarantee

Unless expressly agreed in writing (e.g., under enterprise contracts), CoMeety provides no service-level commitments or uptime guarantees.

12.11. Your Responsibility to Back Up Data

Users should regularly export or back up event details, messages, and other important data. CoMeety is not liable for any lost or corrupted data unless such loss results from gross negligence or willful misconduct. In case recovery is required, you can send an email to support@comeety.app , for the team to export and send it as an email to you.

12.12. Independence of Users

CoMeety users are independent actors. We do not control or assume responsibility for their actions, promises, or statements including you. You acknowledge that CoMeety cannot verify every user, and that responsibility for due diligence, verification, and safe interaction rests with you.

12.13. Third-Party Dependencies

Certain features depend on third-party systems (e.g., hosting, analytics, maps, or payments). CoMeety cannot guarantee uninterrupted access if those providers experience issues.

12.14. Jurisdictional Precedence.

If any disclaimer herein conflicts with mandatory consumer protections under local law, those rights take precedence to the extent required, and all other clauses remain valid.

12.15. Cybersecurity & Data Disclaimer

While CoMeety implements technical and organizational security measures appropriate to the risk, no platform can guarantee absolute protection against unauthorized access, breaches, or loss.

You acknowledge that transmission and storage of data involve inherent risks. Users must maintain secure devices, updated systems, strong credentials, and protected recovery methods, and must not share credentials.

If you suspect a compromise, report it immediately via the support@comeety.app or through the Contact section (§16).

Nothing in this Section excludes or limits CoMeety’s obligations or liability where such exclusion or limitation is prohibited by applicable data-protection, consumer-protection, or cybersecurity law.

12.16. AI-Generated, Automated & Synthetic Content Disclaimer

Some Services may use AI or algorithmic systems for moderation, recommendations, search, summaries, assistance, fraud prevention, or safety.

 

AI-generated content may be inaccurate, incomplete, biased, or unsuitable for a particular purpose. CoMeety does not warrant that AI-generated or synthetic material is correct, complete, unbiased, or free from error.

 

Users must not rely solely on AI outputs for decisions of legal, financial, medical, safety-critical, or similarly significant importance. Where required by Regulation (EU) 2024/1689 or other applicable law, CoMeety will disclose direct interaction with AI, support clear identification of certain synthetic content, and apply machine-readable or other technically feasible markings to outputs produced by CoMeety-provided AI systems.

 

Users uploading deepfakes or other materially generated or manipulated content must comply with the disclosure duties in §6.15. CoMeety may label, restrict, or remove synthetic content that is misleading, unlawful, unsafe, or contrary to these Terms.

 

CoMeety will not make a decision based solely on automated processing that produces legal effects or similarly significant effects for a user unless permitted by applicable law and accompanied by required safeguards, including the ability to obtain human intervention, express a point of view, and contest the decision.

12.17. Data Processing & Cross-Border Transfer Disclaimer

Personal data may be processed in more than one jurisdiction only as described in the Privacy Policy and §17.7.

Where personal data is transferred outside the EEA, CoMeety uses a lawful transfer mechanism and supplementary safeguards where required. International transfers may involve residual risks, including lawful access by public authorities, but nothing in this Section limits rights or remedies that cannot lawfully be waived under the GDPR or other mandatory law.

12.18. Device Integrity & Compatibility

CoMeety cannot ensure that all device types, operating systems, or browsers will function flawlessly with the Services.

Users are responsible for maintaining compatible software and stable network connections.

CoMeety is not responsible for issues arising from outdated devices, unsupported versions, or incompatible system configurations.

12.19. Accessibility & Equal Use

CoMeety is committed to digital accessibility and strives to make its platform usable by all individuals, including people with disabilities.

However, we do not guarantee that every element, integration, or third-party feature will fully comply with specific accessibility standards (e.g., WCAG 2.2 or national equivalents).

We welcome feedback to improve accessibility and will take reasonable corrective actions consistent with technical feasibility and applicable law.

12.20. User Reliance & Responsibility

Users acknowledge that:

 

CoMeety is a community platform, not a certification body, activity organizer, or professional adviser.

 

Decisions made based on platform information or interactions are at the user’s own discretion and risk.

 

Verification, due diligence, and the safety of in-person interactions remain the user’s responsibility.

12.21. Limitation of Public Representations

No statement, promise, or representation by CoMeety staff, partners, or affiliates shall create any warranty or modify these disclaimers unless expressly stated in a written agreement signed by authorized representatives.

12.22. Governing Precedence of Mandatory Laws

Nothing in these disclaimers excludes or limits rights that cannot lawfully be waived—particularly under consumer-protection, privacy, or safety laws.

In case of conflict, the law of the user’s habitual residence prevails to the extent required, while all other provisions remain valid.

 

Definitions & Glossary

Prevents ambiguity 

(e.g., “Organizer,” “Activity,” “User Content,” “Sanctions,” “Material Change”).

 

Order of Precedence: “If a conflict exists, Regional Terms prevail over these Terms where required by law; otherwise these Terms control.”

 

No Dark Patterns: “We do not use deceptive design patterns to obtain consent, retain subscriptions, or mislead users.”

 

Security Research: “We encourage responsible disclosure at security@comeety.app; good-faith research will not be penalized.”

 

DSA Out-of-Court: “EU users may, after our internal appeal, seek out-of-court dispute settlement with a certified body.”

 

Subprocessor Notice: “We publish and update our subprocessor list; material changes are announced at least 30 days in advance.”

13. Limitation of Liability

 

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT COMEETY’S LIABILITY IS LIMITED AS FOLLOWS.

If any portion of this Section is held invalid, the remaining portions remain in full force and effect.

13.1. Scope of Limitation

As stated previously, CoMeety and CoMeety users are totally separate and different parties. To the maximum extent permitted by law, neither CoMeety nor its affiliates, officers, directors, employees, agents, partners, suppliers, or licensors shall be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or other intangible losses arising out of or related to:

(a) your use of, inability to use, or reliance on the Services;

(b) any community, activity, interaction, or transaction facilitated through the Services;

(c) any content or conduct of users or third parties;

(d) unauthorized access to or alteration of your data; or

(e) any other matter relating to the Services, even if CoMeety has been advised of the possibility of such damages.

13.2. Aggregate Cap

Except where prohibited by law or stated otherwise in the Regional Terms, CoMeety’s total cumulative liability to you for all claims arising from or relating to the Services shall not exceed 

(a) the amount you paid to CoMeety during the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US $100)—whichever is greater.

13.3. Exclusions

These limitations do not exclude or limit liability for:

(a) death or personal injury caused by gross negligence, willful misconduct, or fraud;

(b) breach of mandatory consumer-protection rights under applicable law; or

(c) any liability that cannot lawfully be excluded or limited.

13.4. User Responsibility

You remain solely responsible for:

(a) verifying community and activity information;

(b) suitability before attending;

(c) securing your devices, data, and credentials;

(d) maintaining insurance or safety measures appropriate to your participation or hosting of activities; and,

(e) reporting any suspicious activity against Terms & Conditions by other users.

13.5. Organizer Liability / 3. (Third) Party

Organizers and other users act independently. CoMeety is not liable for their actions, representations, omissions, or community/activity outcomes. Any disputes between users are subject to §15.2 (User-to-User Claims & Release).

13.6. Cross-Jurisdiction Notice

In jurisdictions where limitations of liability are restricted, this Section applies only to the fullest extent permitted by law, and the remaining provisions remain effective.

13.7. Reliance Disclaimer

You agree that your decision to use the Services or participate in communities and activities is made at your own discretion and risk, and that the essential purpose of these limitations is to allocate risk between the Parties proportionally to the value exchanged.

13.8. Data & Service Loss

CoMeety maintains commercial general liability and cyber-risk insurance as part of responsible operations. However, CoMeety is not liable for data loss or service interruption caused by:

(a) network or infrastructure failures beyond its control;

(b) third-party integrations; or

(c) maintenance, updates, or software errors, except where due to CoMeety’s gross negligence or intentional misconduct.

13.9. Force Majeure

CoMeety shall not be liable for any delay, failure, or damage resulting from activities beyond its reasonable control, including natural disasters, war, terrorism, protests, upheavals, strikes, government actions, pandemics, power outages, or internet failures.

13.10. Survival

This Section survives termination of your account or this Agreement and continues to apply to any claims, losses, or disputes arising thereafter.

14. Dispute Resolution (“What If We Disagree?”)

14.1. Good Faith Resolution First

Before filing a formal claim, the Parties will attempt to resolve the dispute informally and in good faith. You may contact CoMeety through the methods in §16.1. This informal process does not prevent either Party from seeking urgent relief or exercising a right that cannot lawfully be delayed.

14.2. Governing Law

(a) EEA Consumers: If you are a consumer habitually resident in an EEA country, these Terms and any non-contractual obligations arising from them are governed by the law of that country.

(b) EEA Business and Organization Users: If you use the Services for a trade, business, craft, profession, or organization, these Terms are governed by the law of the EEA country in which the contracting CoMeety entity has its registered office, without prejudice to mandatory law.

(c) Users Outside the EEA: To the extent permitted by mandatory law, these Terms are governed by the law of the EEA country in which the contracting CoMeety entity has its registered office. Nothing in this clause deprives a consumer of mandatory protections that apply in the consumer’s country of habitual residence.

14.3. Courts and Jurisdiction

An EEA consumer may bring proceedings against CoMeety in the competent courts of the consumer’s country of habitual residence or in any other court permitted by applicable law. CoMeety may bring proceedings against an EEA consumer only in the courts permitted by mandatory consumer-jurisdiction rules. EEA business and organization users submit to the courts of the EEA country in which the contracting CoMeety entity has its registered office, unless the Parties agree otherwise in writing or mandatory law requires another forum.

14.4. Alternative and Out-of-Court Dispute Resolution

Where applicable, an EEA consumer may use a competent alternative dispute-resolution body under national law. For eligible content-moderation disputes covered by the Digital Services Act, recipients may select a certified out-of-court dispute-settlement body under DSA Article 21. Such a procedure does not remove the right to bring court proceedings at any stage.

14.5. No Mandatory Pre-Dispute Arbitration for EEA Consumers

EEA consumers are not required by these Terms to submit disputes to binding arbitration, waive a jury right, or waive rights to collective or representative redress available under mandatory law. After a dispute has arisen, the Parties may agree separately in writing to arbitration or another settlement procedure where lawful.

14.6. Immediate Suspension and Interim Relief

CoMeety may take immediate proportionate action under §7 where reasonably necessary to address imminent harm, illegal activity, fraud, or security threats. Nothing in this Section prevents either Party from seeking temporary, protective, or injunctive relief from a competent court.

14.7. Preservation of Evidence

CoMeety may preserve relevant account information and communications only where necessary and lawful for an investigation, appeal, legal obligation, or the establishment, exercise, or defense of legal claims. Retention is governed by §8.6 and §17.12. Preserved material may be used in internal proceedings or lawful judicial, regulatory, or dispute-resolution processes.

14.8. Time to Bring Claims

Claims are subject to the limitation periods established by the applicable mandatory law. Nothing in these Terms shortens a consumer’s statutory limitation period.

14.9. Coordination with Authorities

CoMeety may cooperate with competent courts, regulators, and law-enforcement authorities where required or permitted by law. Requests are assessed for validity, necessity, scope, and proportionality, and personal data is handled in accordance with §17.

14.10. Severability

If any provision of this Section is invalid or unenforceable, the remaining provisions remain effective, and the affected provision will apply to the maximum extent permitted by law.

14.11. Recovery of Direct Losses

Subject to mandatory consumer law and §13, CoMeety may seek recovery of direct and documented losses, chargeback costs, or legal expenses caused by a user’s breach, fraud, or unlawful conduct.

15. Indemnification, User-to-User Claims & Enforcement

15.1. Indemnification by Users

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless CoMeety, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, demands, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from or related to:

(a) your access to or use of the Services;

(b) your content, conduct, or participation in communities or activities;

(c) your breach of these Terms, Community Guidelines, or applicable law;

(d) your violation of another person’s rights (including intellectual property, privacy, or data-protection rights); or

(e) any dispute, claim, or loss between you and another user, organizer, attendee, or third party.

 

CoMeety reserves the right to assume exclusive defense and control of any matter otherwise subject to indemnification. You agree to cooperate with CoMeety’s reasonable requests in such cases.

15.2. User-to-User Claims & Release

CoMeety provides a digital venue for connection but is not a party to interactions or contracts between users. To the maximum extent permitted by law, you release CoMeety and its affiliates from any claims, demands, or damages arising from disputes with other users or third parties, including organizers or participants.

 

If a dispute arises between users, the Parties are expected to:

(a) attempt direct resolution through communication;

(b) escalate to CoMeety’s moderation or support team via ReportHub only where safety or fraud is implicated.

 

CoMeety may, but is not obligated, to facilitate informal resolution, and doing so does not make CoMeety a party to the dispute.

15.3. Enforcement Measures & Sanctions

CoMeety may enforce these Terms and Community Guidelines using a graduated enforcement model, consistent with fairness and applicable law:

(a) Educational notice or warning;

(b) Temporary restriction (chat, publishing, activity creation, or payout hold);

(c) Account suspension or content removal;

(d) Permanent account termination;

(e) Referral to law enforcement or authorities where required.

 

Immediate action (including suspension or termination without prior notice) may occur when CoMeety reasonably believes that:

 

continued access may cause imminent harm to others, minors, or the platform’s integrity;

 

fraudulent, deceptive, or illegal behavior is detected; or

 

law or regulatory obligations require urgent restriction.

15.4. Notice, Appeals & Restoration

Unless prohibited by law, CoMeety will notify affected users of significant enforcement actions and provide a summary of the reasons and available complaint or redress options.

 

Appeals: Eligible appeals may be submitted through ReportHub or the support@comeety.app in §16.1. Where DSA Article 20 applies, complaints may be submitted for at least six (6) months after notification of the decision. For other eligible decisions, appeals may be submitted within 30 days unless a longer period is required by law.

 

Review: Appeals are reviewed in good faith under the supervision of appropriately qualified personnel and are not decided solely through automated means where prohibited by law.

 

Restoration: If an appeal succeeds, access or content will be restored or the restriction narrowed where feasible. The user will receive a reasoned outcome and information on further redress options where required.

 

Manifestly unfounded, abusive, or repetitive complaints may be restricted in a proportionate manner and in accordance with applicable law.

15.5. Evidence Preservation & Reservation of Legal Cooperation

CoMeety may preserve relevant data, including messages, activity records, security logs, and account identifiers, only where necessary and proportionate to:

(a) investigate policy violations, fraud, or safety incidents;

(b) comply with valid legal requests or legal obligations;

(c) handle complaints or appeals; or

(d) establish, exercise, or defend legal claims.

Retention is governed by §8.6 and §17.12 rather than a single fixed period. CoMeety may disclose personal data to competent authorities only where necessary and lawful and will assess requests for validity, scope, and proportionality.

15.6. Anti-Circumvention

Creating, maintaining, or using alternate accounts to evade enforcement or participate after suspension is strictly prohibited.

CoMeety may link and act upon related accounts or devices where reasonable evidence supports identity association.

15.7. Fraud, Misuse & Illegal Activity

CoMeety may restrict, freeze, or reverse payouts; remove communities or activities; or refer cases to payment processors or authorities if there is credible evidence of:

(a) fraud, scam, or money laundering;

(b) potential risk of harm to any party;

(c) unauthorized transactions or chargebacks;

(d) impersonation or misrepresentation; or

(e) any unlawful or unethical use of the platform.

 

CoMeety may share minimal, relevant data (e.g., transaction logs or account identifiers) with payment partners solely for compliance and investigation purposes.

15.8. Reservation of Rights

Failure to enforce any provision does not constitute a waiver of rights. CoMeety may pursue all remedies available at law or in equity. Exercise of one remedy does not preclude others.

15.9. Fairness & Transparency Commitment

CoMeety applies enforcement consistently, proportionately, and non-discriminatorily.

We maintain internal moderation guidelines and publish annual transparency summaries describing volumes and categories of enforcement actions, consistent with our ethical and legal commitments.

15.10. Survival

The obligations in this Section—including indemnification, release, preservation, and cooperation—survive termination of your account or this Agreement.

16. Contact, Notices & Communication Channels

Notices are considered received:

 

By email: on the date sent, if transmission is confirmed;

16.2. User Notices

You agree that CoMeety may communicate with you electronically, including by email, push notifications, in-app messages, or postings on the platform.

Such communications may include:

(a) service announcements, updates, and policy changes;

(b) security or enforcement notifications;

(c) billing and payment information; and

(d) responses to support inquiries.

 

You are responsible for maintaining accurate contact information in your account settings. CoMeety is not liable for any missed communications resulting from outdated contact details, spam filters, or technical failures outside its control.

16.3. Legal Service & Formal Notice

 

All legal notices, including subpoenas and service of process, must be sent to the address specified in §16.1. CoMeety may reject informal legal correspondence sent through customer-support channels.

 

If required by law, CoMeety may provide notice to you via:

(a) your registered email address;

(b) the mailing address on file; or

(c) in-app notification (for digital-only users).

16.4. Electronic Consent & Records

By using the Services, you consent to the use of electronic signatures, agreements, and records for all contractual and notification purposes. These communications satisfy any legal requirement that such records be in writing.

16.5. Service of Enforcement Actions

Where enforcement actions (§7 or §15) are taken, notifications shall be delivered through the same verified channels (email and in-app). Failure to read or acknowledge such notice does not excuse liability or delay its effect.

16.6. Notices of Alleged Violations (User Reports)

Users may report policy or law violations through:

(a) the in-app “ReportHub ” feature; or

(b) by emailing support@comeety.app

with relevant evidence or context.

CoMeety reviews all credible reports in accordance with the moderation framework (§7).

 

If you submit a report, you agree that:

 

(a) your report must be made in good faith,

 

(b) false or malicious reports may themselves constitute violations, and

 

CoMeety may share report summaries (without personal data) with enforcement or dispute bodies if required. 

 

By reporting through ReportHub or support@comeety.app, you allow CoMeety to take related legal/juristical action. Hereby, based on the context, CoMeety independently can appeal to court with lawful appropriate data for securing the rights of CoMeety and the CoMeety users.

16.7. Official Language

All communications with CoMeety shall be conducted in English, unless otherwise mandated by regional consumer law. Where translations exist, the English version prevails in case of ambiguity.

16.8. Public Announcements & Press

Users and organizers may not issue public statements, press releases, or media comments referencing CoMeety without prior written approval, except where legally required.

16.9. Law Enforcement & Government Requests

CoMeety provides a dedicated portal for authorized law-enforcement entities to submit valid legal requests, subpoenas, or emergency disclosures.

We evaluate all requests for legality, scope, and proportionality and may require clarification or judicial validation before disclosure.

16.10. Feedback Submissions & Intellectual Rights

By submitting feedback, ideas, or suggestions to CoMeety, you grant us a worldwide, royalty-free, perpetual, irrevocable license to use, modify, and incorporate that feedback without compensation.

16.11. Emergency & Safety Escalation

Safety reports flagged as urgent are routed immediately to our 24/7 Safety Response Team.

16.12. Subpoena-Cost Reimbursement

CoMeety reserves the right to recover reasonable costs incurred in responding to excessive, duplicative, or improper legal process.

17. Data Protection Addendum (GDPR & Applicable Privacy Laws)

CoMeety processes personal data in accordance with applicable data-protection law and the Privacy Policy. If this Addendum conflicts with mandatory data-protection law, the mandatory law prevails.

17.1. Scope, Controller Identity & Roles

The CoMeety entity identified in §1.1 is generally the controller of personal data processed to provide, secure, personalize, and administer the Services. Its contact details are provided in §16.1 and the Privacy Policy.

 

An organizer may act as an independent controller for personal data it receives and determines how to use for its own activity operations. CoMeety acts as a processor only where it processes personal data solely on documented instructions under a written agreement meeting GDPR Article 28. Where CoMeety and an organizer jointly determine the purposes and essential means of processing, they will allocate responsibilities in a transparent arrangement under GDPR Article 26 and make the essence of that arrangement available to affected users.

17.2. Data Protection Principles

CoMeety applies the principles of lawfulness, fairness, transparency, purpose limitation, data minimization, accuracy, storage limitation, integrity, confidentiality, and accountability. Personal data is deleted or genuinely anonymized when it is no longer necessary for the relevant purpose and no lawful retention ground remains.

17.3. Records, Privacy by Design & Governance

CoMeety maintains records of processing activities where required, applies data protection by design and by default, assesses vendor and subprocessor risk, and conducts data-protection impact assessments before processing that is likely to result in a high risk to individuals.

17.4. Categories of Personal Data

Depending on the features used, CoMeety may process:

(a) account and profile data, including name, contact details, language, region, interests, and adult-status or age-verification information where necessary;

(b) usage and community data, including memberships, activities, attendance, messages, interactions, preferences, and User Content;

(c) device, network, cookie, and log data, including IP address, device type, operating system, browser, identifiers, and security events;

(d) transaction, invoice, payout, and payment-token data if paid services are activated;

(e) location data where a location feature is enabled and the required permission or legal basis exists;

(f) safety, moderation, verification, fraud-prevention, and compliance data; and

(g) support communications and records of consent, preferences, complaints, and legal requests.

 

Special-category data under GDPR Article 9, and biometric data used for unique identification, will be processed only where a specific Article 9 condition and Article 6 legal basis apply, with appropriate safeguards. Users should not disclose unnecessary sensitive data in public or community areas.

17.5. Purposes and Legal Bases

CoMeety processes personal data only for specified purposes and under an applicable legal basis, including:

(a) performance of a contract: account creation, authentication, communications, communities, activities, support, and requested features;

(b) compliance with legal obligations: tax, accounting, consumer protection, sanctions, lawful authority requests, and regulatory duties;

(c) legitimate interests: service security, fraud prevention, platform integrity, proportionate moderation, service measurement, product improvement, and the establishment, exercise, or defense of legal claims, after balancing those interests against user rights;

(d) consent: optional marketing, non-essential cookies, certain personalization, optional precise location, and other features where consent is required; and

(e) vital interests or public-interest grounds: exceptional processing necessary to protect life or respond to a serious safety emergency, where legally available.

 

Consent may be withdrawn at any time through the available settings, ReportHub, or support@comeety.app, without affecting processing already carried out lawfully before withdrawal.

17.6. Data Sharing, Recipients & Subprocessors

CoMeety may disclose personal data only where necessary and lawful to service providers and subprocessors, organizers or users selected by you, affiliates supporting the Services, professional advisers, payment providers once activated, competent authorities, or a successor in a lawful corporate transaction.

 

Processors are bound by written agreements that address GDPR Article 28 requirements. CoMeety remains responsible for selecting and overseeing processors within the scope required by law. A current subprocessor list may be published through CoMeety’s legal pages, and material changes will be notified where required.

 

CoMeety does not sell personal data. A disclosure to a service provider, organizer, authority, or other recipient may nevertheless constitute sharing or another regulated disclosure under applicable law and will be described in the Privacy Policy.

17.7. International Data Transfers

Personal data transferred outside the EEA will be protected through a lawful GDPR Chapter V mechanism, such as an adequacy decision, the European Commission’s Standard Contractual Clauses, binding corporate rules, or another valid safeguard or derogation. Where required, CoMeety will assess transfer risks and apply supplementary technical, contractual, or organizational measures. Users may request information about the applicable safeguard, subject to lawful redactions.

17.8. Data Subject Rights

Subject to applicable conditions and exceptions, you may request access, rectification, erasure, restriction, portability, or objection; withdraw consent; object to direct marketing; and lodge a complaint with a competent supervisory authority.

 

Requests may be submitted through ReportHub or support@comeety.app. CoMeety may verify identity and clarify the scope of a request. We will respond without undue delay and normally within one month. Where permitted by GDPR Article 12(3), that period may be extended by up to two further months because of complexity or the number of requests, and we will inform you of the extension and reasons within the first month.

 

A request may be refused or a reasonable fee charged only where permitted by law, including where a request is manifestly unfounded or excessive. Rights may be limited where necessary to protect the rights and freedoms of others, legal privilege, security, fraud prevention, or another restriction established by law.

17.9. Automated Decision-Making, Profiling & AI

CoMeety may use automated systems for recommendations, moderation assistance, safety-risk detection, fraud prevention, and service personalization. Where GDPR Article 22 applies, CoMeety will not make a decision based solely on automated processing that produces legal effects or similarly significant effects unless a lawful exception applies and required safeguards are provided.

 

Where required, users will receive meaningful information about the relevant logic and significance of processing and may request human intervention, express a point of view, and contest a significant decision. DSA complaint decisions will not be taken solely by automated means where Article 20 applies. AI transparency and synthetic-content duties are further described in §§6.15, 12.4, and 12.16.

17.10. Security of Processing

CoMeety implements technical and organizational measures appropriate to the risk, taking account of the state of the art, implementation costs, the nature and context of processing, and potential harm to individuals. Measures may include encryption in transit and at rest where appropriate, access controls, least-privilege permissions, logging, secure development, vulnerability management, backups,rate-limiting, incident response, vendor controls, and staff training.

 

No system is completely secure. Security descriptions do not constitute a guarantee that an incident will never occur. Users must protect credentials, devices, and recovery methods and must promptly report suspected compromise.

17.11. Personal Data Breach Notification

CoMeety documents and assesses personal data breaches. Where a breach is likely to result in a risk to the rights and freedoms of individuals, CoMeety will notify the competent supervisory authority without undue delay and, where feasible, within 72 hours after becoming aware of the breach, as required by GDPR Article 33.

 

Where a breach is likely to result in a high risk to affected individuals, CoMeety will communicate the breach to those individuals without undue delay, unless an exception under GDPR Article 34 applies. Notifications will describe the nature of the breach and the available mitigation information in clear language.

17.12. Retention and Deletion

The retention periods in §8.6 are the authoritative default schedule for these Terms. CoMeety reviews retention by purpose and data category and applies shorter periods where possible. Data subject requests are handled under §17.8; account deletion and backup treatment are governed by §8.

17.13. Organizers and Participant Data

Organizers may use participant data only for the disclosed and lawful operation of the relevant activity or community. They must not sell, reuse, enrich, or market participant data without a separate valid legal basis and any required notice or consent. Depending on the processing, an organizer may be an independent controller, joint controller, or processor as described in §17.1.

17.14. Data Protection Contact & Supervisory Authorities

Privacy questions and rights requests may be sent to support@comeety.app. CoMeety’s data-protection contact and, where formally appointed, Data Protection Officer may be reached at support@comeety.app and the postal address in §16.1.

 

You may lodge a complaint with the supervisory authority in the EEA country of your habitual residence, place of work, or the place of the alleged infringement. You are encouraged, but not required, to contact CoMeety first so that we may address the concern.

17.15. Data Protection Impact Assessments

CoMeety conducts a DPIA before processing that is likely to result in a high risk to individuals, including where required for systematic monitoring, large-scale sensitive-data processing, precise location features, or certain AI and profiling uses. Where residual high risk remains, CoMeety will consult the competent supervisory authority where required.

17.16. Underage Data and Account Removal

CoMeety is an adult-only service and does not knowingly permit accounts under 18. If CoMeety reasonably determines that an account belongs to a person under 18, it may suspend the account, request proportionate age verification, and delete the account and associated personal data in accordance with §§2.2, 2.12, and 8, while retaining only information that is legally required or necessary to protect safety and prevent repeat registration.

17.17. Updates to This Addendum

This Addendum may be updated to reflect legal or operational changes in accordance with §5. Material changes will be notified and, where required, will take effect only after the applicable notice period or affirmative acceptance. Changes do not retroactively remove rights that have already accrued.

18. Miscellaneous / General Provisions

18.1. Entire Agreement

These Terms, together with the Privacy Policy, Community Guidelines, Data Protection Addendum, and any Additional Terms expressly referenced herein, constitute the entire agreement between you and CoMeety regarding your use of the Services. They supersede all prior or contemporaneous understandings, agreements, or communications, whether written or oral, relating to the subject matter herein.

 

All materials in this Terms & Conditions are bundled. There is no option for partial agreement. Signing CoMeety Terms & Conditions means you agree with each and every material in this agreement. If any of these materials is/are inappropriate to you, do not sign the agreement and do not use CoMeety.

18.2. Order of Precedence

In the event of any inconsistency:

(a) Regional Terms (EU/EEA/UK/US) prevail over this document where required by law;

(b) Additional Terms for specific features or partnerships prevail over general provisions for those features; and

(c) otherwise, these Terms control.

 

Headings are for convenience only and do not affect interpretation.

18.3. Assignment

You may not assign, transfer, or delegate these Terms and Conditions, in whole or in part, without CoMeety’s prior written consent.

CoMeety may assign or transfer these Terms and Conditions, in whole or in part, without notice, including in connection with a merger, acquisition, or sale of assets, provided that your rights are not materially affected.

 

Any attempted assignment in violation of this clause is void.

18.4. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent authority, the remaining provisions shall remain in full force and effect, and the invalid portion shall be interpreted in the nearest permissible manner consistent with its original intent.

18.5. Waiver

Failure or delay by CoMeety to enforce any right or provision under these Terms and Conditions does not constitute a waiver of that right or provision. A waiver is valid only if made in writing and signed by an authorized representative of CoMeety.

18.6. Third-Party Beneficiaries

Except as expressly stated (e.g., payment processors, licensors, or lawful successors), these Terms and Conditions do not create any rights or benefits for third parties. Users may not assert rights on behalf of others.

18.7. Force Majeure

Neither Party shall be liable for failure or delay in performance due to causes beyond its reasonable control, including natural disasters, acts of government, upheavals, war, terrorism, pandemics, labor disputes, internet outages, or failures of third-party infrastructure providers.

CoMeety will make reasonable efforts to restore functionality and communicate updates promptly in such events.

18.8. Notices & Communications

All notices shall be given in accordance with §16 (Contact, Notices & Communication Channels).

Electronic communications (email, in-app, push notifications) satisfy any legal requirement for written notice unless a specific form is required by law.

18.9. Governing Language

These Terms are drafted in English. Where translations exist, the English version prevails in case of inconsistency.

18.10. Survival

The following provisions survive termination or expiration of this Agreement: §§3 and 6–18, as applicable, together with any rights or obligations that by their nature must continue after termination.

18.11. Interpretation

For interpretation purposes:

 

“Including” means “including without limitation.”

 

“Or” is inclusive (not exclusive).

 

Singular terms include the plural and vice versa.

 

References to “laws” include all amendments and successor regulations.

18.12. Relationship of the Parties

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and CoMeety. Each Party acts independently and bears sole responsibility for its actions.

18.13. Public Policy & Export Control

You agree not to use or export the Services in violation of applicable export control, sanctions, or trade laws (e.g., EU, UK, US OFAC). CoMeety may restrict access where required by such regulations.

18.14. Equitable Relief

CoMeety may seek injunctive or equitable relief (including specific performance) in any court of competent jurisdiction to prevent actual or threatened violations of human - intellectual property rights or confidentiality obligations.

18.15. Headings & Formatting

Section and paragraph headings are for organizational clarity only and shall not affect interpretation or enforceability.

18.16. Non-Exclusivity of Remedies

All remedies under these Terms are cumulative and not exclusive of other remedies available in equity or law.

19. Artificial Intelligence Features, Content & Responsible Use

19.1. Scope and Relationship with Existing Terms

CoMeety may provide artificial-intelligence and automated features that assist users in creating, editing, summarizing, translating, organizing, or reviewing content, including ideas, articles, guides, surveys, petitions, activity etc. descriptions, community materials, and similar content. This Section supplements, and does not replace, the rules in §§4, 6, 7, 12, and 17. AI-Assisted Content remains subject to the same conduct, intellectual-property, privacy, moderation, safety, and enforcement requirements that apply to other User Content.

Nothing in this Section permits conduct prohibited elsewhere in these Terms, the Community Guidelines, Additional Terms, or applicable law. Where a specific AI feature displays additional conditions before use, those conditions form Additional Terms for that feature in accordance with §§1.5 and 5.9.

19.2. Definitions

“AI Feature” means a feature made available through the Services that uses an artificial-intelligence model or automated system, whether operated by CoMeety or by a service provider acting for CoMeety.

“Input” means any prompt, instruction, text, image, audio, video, file, dataset, reference material, personal data, or other content submitted to an AI Feature.

“Output” means any listing, text, image, audio, video, suggestion, summary, draft, response, classification, or other material generated or returned by an AI Feature in response to an Input or user interaction.

“AI-Assisted Content” means an Output that a user selects, edits, saves, publishes, shares, distributes, relies upon, or otherwise uses through or outside the Services.

19.3. Ownership and Permitted Use of Inputs

You retain any ownership and intellectual-property rights that you lawfully hold in your Input. You grant CoMeety, its affiliates, and its authorized service providers a non-exclusive, worldwide, royalty-free licence to host, reproduce, transmit, format, analyze, and otherwise process the Input only as reasonably necessary to provide the requested AI Feature, maintain security, prevent misuse, comply with law, resolve disputes, and perform any additional use that has been clearly disclosed and is supported by an applicable legal basis.

You represent and warrant that you have the rights, permissions, authority, and lawful basis necessary to submit and process each Input. Submitting material to an AI Feature does not transfer to you any right belonging to another person.

19.4. Rights in Outputs

As between you and CoMeety, and subject to applicable law, third-party rights, and these Terms, you may use, reproduce, adapt, save, and publish an Output generated for you through the Services for lawful purposes. To the extent CoMeety acquires any transferable intellectual-property right in that Output, CoMeety assigns that right to you when the Output is generated.

This permission and assignment do not transfer any right in CoMeety’s software, AI models, system instructions, confidential methods, templates, interfaces, designs, trademarks, datasets, safety mechanisms, or other pre-existing materials. They also do not transfer rights in third-party materials that may appear in, be referenced by, or be substantially reproduced in an Output.

19.5. No Guarantee of Copyright, Exclusivity, or Originality

The legal protection available for AI-generated material may depend on the nature and extent of human creative contribution and the law of the relevant jurisdiction. CoMeety does not represent or guarantee that an Output:

(a) qualifies for copyright, patent, design, database, trade-secret, or other intellectual-property protection;

(b) is unique or exclusive to you;

(c) has not been, or will not be, generated in a similar or identical form for another user;

(d) is free from third-party copyright, trademark, privacy, publicity, personality, confidentiality, database, contractual, or other rights;

(e) is suitable for registration, commercial exploitation, publication, licensing, or enforcement against another person; or

(f) accurately reflects the style, authorship, identity, approval, or endorsement of any person or organization.

19.6. AI-Assisted Content as User Content and User Responsibility

An Output becomes User Content for the purposes of §6 when you save, publish, share, distribute, or otherwise make it available through the Services. The licence granted to CoMeety under §6.2 and the warranties in §6.3 then apply to that AI-Assisted Content.

Outputs are drafts and must not be treated as verified facts, professional advice, official records, completed publications, genuine public support, or CoMeety endorsements. Before using an Output, you must reasonably review it for accuracy, lawfulness, originality, attribution, permissions, privacy, safety, suitability, and compliance with these Terms. You remain responsible for the AI-Assisted Content you use or publish, including its claims, citations, quotations, signatures, images, statistics, instructions, and representations. Even if the content published is generated by support of AI with or without user intervention, still the entire responsibility belongs to the user who published the content and will be treated accordingly in CoMeety reviews.

19.7. AI-Specific Prohibited Conduct

In addition to §4.2, you must not use, attempt to use, or assist another person to use an AI Feature to:

(a) infringe or misappropriate intellectual-property, privacy, publicity, personality, confidentiality, database, contractual, or other rights;

(b) submit personal data, confidential information, trade secrets, private communications, access credentials, or images or recordings of another person without appropriate authority, permission, and a lawful basis;

(c) impersonate a person or organization, create a misleading digital replica, fabricate an endorsement, or falsely represent that content was created, approved, signed, supported, or published by another person;

(d) fabricate or simulate petition signatures, supporters, votes, survey responses, activity attendance, testimonials, reviews, evidence, citations, quotations, research findings, statistics, credentials, qualifications, or official records;

(e) generate or distribute misinforming, fraudulent, defamatory, deceptive, unlawfully discriminatory, exploitative, violent, sexually exploitative, or otherwise unlawful material;

(f) generate malicious code, phishing material, credential-stealing content, instructions intended to bypass security, or content intended to facilitate unauthorized access, fraud, or cyber abuse;

(g) bypass safety protections, usage limits, access controls, content filters, geographic restrictions, or other technical safeguards;

(h) discover, extract, reproduce, reverse engineer, or infer confidential system instructions, model parameters, protected training data, security mechanisms, source code, or non-public technical information;

(i) use automated methods to generate, publish, or distribute excessive, repetitive, duplicative, misleading, or spam content;

(j) manipulate CoMeety’s moderation, reporting, ranking, recommendation, voting, survey, petition, badge, verification, or enforcement systems;

(k) infer sensitive or highly sensitive information about another person, or classify, rank, target, or discriminate against a person based on protected or sensitive characteristics, where such processing is unlawful;

(l) create content that falsely appears to be professional medical, legal, psychological, financial, safety, emergency, or other regulated advice;

(m) remove, conceal, falsify, or materially interfere with a legally required AI disclosure, provenance indicator, watermark, metadata marker, or authenticity signal; or

(n) engage in a practice prohibited by applicable artificial-intelligence law, including unlawful manipulation, exploitation of vulnerability, social scoring, biometric categorization, or other prohibited use.

CoMeety may refuse to generate an Output, apply usage limits, require verification, preserve relevant records, label or remove AI-Assisted Content, restrict an AI Feature, or take enforcement action under §§7 and 15 where it reasonably believes that an AI Feature has been misused.

19.8. Factual Claims, Sources, and Citations

AI-generated references, quotations, citations, links, statistics, names, dates, legal provisions, medical information, scientific findings, and other factual claims may be incomplete, outdated, incorrectly attributed, or fabricated. Before publishing or relying on such material, you must verify it against reliable primary or authoritative sources. Even if the content published is generated by support of AI with or without user intervention, still the entire responsibility belongs to the user who published the content and will be treated accordingly in CoMeety reviews.

CoMeety may display sources, confidence notices, warnings, or verification prompts, but does not guarantee that a displayed source supports an Output or that an AI-generated factual statement is correct. You must not knowingly publish fabricated citations, invented quotations, manipulated evidence, or materially false factual claims. 

19.9. Transparency, Labelling, and Synthetic Content

CoMeety will provide the disclosures and technical measures required by applicable law, including Regulation (EU) 2024/1689, where an AI system directly interacts with a user or generates or materially manipulates text, image, audio, or video content. Depending on the feature and CoMeety’s legal role, this may include visible notices, machine-readable markings, provenance information, detection-support measures, or other technically feasible indicators.

Where an Output is labelled or marked as AI-generated or AI-assisted, you must preserve that disclosure when publishing or distributing the Output where required by law or reasonably necessary to prevent deception. Deepfakes and AI-generated or manipulated text published for the purpose of informing the public on matters of public interest remain subject to §6.15 and the applicable disclosure obligations. Artistic, satirical, fictional, or analogous content remains subject to the legally applicable form of disclosure.

CoMeety may use recognized codes of practice, technical standards, interoperable provenance methods, or EU labelling icons as compliance tools. Use of a particular tool or icon does not by itself constitute a guarantee of legal compliance.

19.10. Third-Party AI Services

CoMeety may use third-party AI models, hosting infrastructure, retrieval systems, safety tools, or other service providers to process Inputs and generate Outputs. Such providers are subject to appropriate contractual, confidentiality, security, data-protection, and international-transfer safeguards as described in the Privacy Policy and §17.

Where required by law, the relevant AI Feature or Privacy Policy will identify material information about provider processing, including the categories of data processed, purposes, retention, international transfers, and whether Inputs or Outputs may be used for provider model improvement. Provider-specific restrictions clearly presented before use may form Additional Terms for that feature.

19.11. Personal Data and Sensitive Information in AI Features

Do not submit personal data that is unnecessary for the requested purpose. Unless an AI Feature expressly states that it is designed and legally supported for such processing, you must not submit special-category personal data, highly sensitive information, precise location histories, identity documents, financial credentials, health records, biometric data, private communications, or confidential information belonging to another person.

The Privacy Policy and any feature-specific notice will describe whether Inputs and Outputs are stored, the applicable retention period, whether authorized personnel may review them, which providers receive them, whether they are transferred outside the EEA, and how available deletion or access controls operate. Prompt histories and uploaded files are retained only in accordance with §8.6, §17.12, and the applicable notice.

19.12. Model Improvement, Training, and Evaluation

The use of Inputs, Outputs, or User Content for model improvement, training, fine-tuning, evaluation, safety testing, or quality review is governed by §6.16, §17, and the Privacy Policy. CoMeety will not treat encrypted or pseudonymized data as anonymous where it remains reasonably linkable to a person.

CoMeety will not authorize a third-party AI provider to use identifiable Inputs or Outputs to train a general-purpose model unless that use has been clearly disclosed, is supported by an applicable legal basis, and includes any consent, objection right, opt-out, or other choice required by law. Where CoMeety develops or fine-tunes a model using personal data, it will apply purpose limitation, data minimization, source assessment, accuracy controls, security measures, retention limits, and any required data-protection impact assessment.

19.13. Automated Decisions and Human Review

AI Features may assist with recommendations, moderation, safety, fraud prevention, search, categorization, and personalization. The safeguards in §§7.4, 7.5, 12.4, 12.16, and 17.9 apply to automated processing and decisions.

Where GDPR Article 22, the Digital Services Act, or another applicable law requires it, CoMeety will provide meaningful information about the use and significance of automated processing and an effective opportunity to obtain human intervention, express a point of view, and contest an eligible decision. A decision that produces legal effects or similarly significant effects will not be based solely on automated processing unless a lawful condition and the required safeguards apply.

19.14. Text and Data Mining, Scraping, and AI Training by Third Parties

Except where expressly authorized in writing or permitted by mandatory law, third parties may not scrape, crawl, extract, reproduce, download, or use CoMeety Materials, the Services, or non-public User Content to train, fine-tune, evaluate, benchmark, ground, or improve an artificial-intelligence model or dataset. This restriction supplements §10.4.

CoMeety reserves all text-and-data-mining rights that it lawfully controls in CoMeety Materials, including the reservation contemplated by Article 4(3) of Directive (EU) 2019/790, and may express that reservation through machine-readable means. CoMeety does not claim ownership of User Content merely because it is processed through the Services. Any reservation or permission relating to rights retained by a user remains subject to that user’s rights, the licence granted under §6.2, and applicable law.

19.15. Surveys, Petitions, and Public-Interest Content

An AI Feature may assist with drafting or organizing the wording of a survey, petition, guide, article, or other public-interest content where that activity is otherwise permitted by §4.2, the Community Guidelines, and applicable law. AI assistance must not be used to create the false appearance of public support, participation, expertise, evidence, or consensus.

AI must not generate, cast, or simulate survey responses, votes, petition signatures, supporters, endorsements, or attendance records. Nothing in this Section permits political campaign activity or election influence prohibited by §4.2(m). If CoMeety later permits paid political advertising or regulated political promotion, separate Additional Terms and legally required transparency, sponsor, targeting, and recordkeeping measures will apply before that feature is activated.

19.16. AI Governance, Risk Management, and Compliance Roles

CoMeety will assess its role for each AI Feature under applicable law, including whether it acts as a provider, deployer, downstream provider, controller, processor, or joint controller. The legal role may differ by feature and may change when a model, intended purpose, provider, or level of control changes.

CoMeety will maintain governance measures appropriate to the nature and risk of its AI Features and its legal obligations. These measures may include an AI-system inventory, provider and vendor due diligence, contractual controls, data-protection and fundamental-rights assessments, output and bias testing, copyright and data-provenance records, security testing, human-oversight procedures, incident response, complaint handling, model-change review, and documentation sufficient to demonstrate compliance.

These governance measures do not constitute a warranty that an AI Feature will be error-free, unbiased, uninterrupted, or suitable for every purpose.

19.17. AI Literacy and Human Oversight

CoMeety will take proportionate measures to ensure an appropriate level of AI literacy among personnel and other persons operating AI systems on its behalf, taking account of their role, knowledge, experience, the context of use, and the persons affected. Training and guidance may address safe prompting, privacy, sensitive data, copyright, source verification, bias, discrimination, synthetic media, human review, incident escalation, and user complaints.

Users remain responsible for exercising appropriate judgement and oversight when using an AI Feature and must not present an unreviewed Output as verified, authoritative, or independently created by a human where that representation would be misleading.

19.18. Complaints, Intellectual-Property Notices, and Redress

You may report AI misuse, misleading synthetic content, suspected infringement, privacy concerns, or an eligible automated decision through ReportHub or support@comeety.app. Intellectual-property notices and counter-notices are handled under §§6.6 and 6.12. Moderation appeals and legally required human review are handled under §§7.5, 7.15, and 17.9.

CoMeety may request information reasonably necessary to investigate the report and may preserve relevant Inputs, Outputs, logs, labels, and account records in accordance with §§8.6 and 17.12. Reports and complaints must not be knowingly false, abusive, or submitted to harass another person.

19.19. Changes, Suspension, and Survival

AI models, providers, capabilities, limitations, safeguards, and Outputs may change over time. CoMeety may replace, update, suspend, restrict, or discontinue an AI Feature where reasonably necessary for security, quality, legal compliance, provider availability, responsible use, or the management of material risk, subject to §§5 and 11 and any mandatory consumer rights.

The provisions of this Section concerning ownership, licences, responsibility for published content, prohibited conduct, confidentiality, intellectual-property protection, preservation, and dispute resolution survive termination to the extent necessary to give them effect.

Material changes will be notified and, where required, will take effect only after the applicable notice period or affirmative acceptance. Changes do not retroactively remove rights that have already accrued.

18. Miscellaneous / General Provisions

18.1. Entire Agreement

These Terms, together with the Privacy Policy, Community Guidelines, Data Protection Addendum, and any Additional Terms expressly referenced herein, constitute the entire agreement between you and CoMeety regarding your use of the Services. They supersede all prior or contemporaneous understandings, agreements, or communications, whether written or oral, relating to the subject matter herein.

 

All materials in this Terms & Conditions are bundled. There is no option for partial agreement. Signing CoMeety Terms & Conditions means you agree with each and every material in this agreement. If any of these materials is/are inappropriate to you, do not sign the agreement and do not use CoMeety.

18.2. Order of Precedence

In the event of any inconsistency:

(a) Regional Terms (EU/EEA/UK/US) prevail over this document where required by law;

(b) Additional Terms for specific features or partnerships prevail over general provisions for those features; and

(c) otherwise, these Terms control.

 

Headings are for convenience only and do not affect interpretation.

18.3. Assignment

You may not assign, transfer, or delegate these Terms and Conditions, in whole or in part, without CoMeety’s prior written consent.

CoMeety may assign or transfer these Terms and Conditions, in whole or in part, without notice, including in connection with a merger, acquisition, or sale of assets, provided that your rights are not materially affected.

 

Any attempted assignment in violation of this clause is void.

18.4. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent authority, the remaining provisions shall remain in full force and effect, and the invalid portion shall be interpreted in the nearest permissible manner consistent with its original intent.

18.5. Waiver

Failure or delay by CoMeety to enforce any right or provision under these Terms and Conditions does not constitute a waiver of that right or provision. A waiver is valid only if made in writing and signed by an authorized representative of CoMeety.

18.6. Third-Party Beneficiaries

Except as expressly stated (e.g., payment processors, licensors, or lawful successors), these Terms and Conditions do not create any rights or benefits for third parties. Users may not assert rights on behalf of others.

18.7. Force Majeure

Neither Party shall be liable for failure or delay in performance due to causes beyond its reasonable control, including natural disasters, acts of government, upheavals, war, terrorism, pandemics, labor disputes, internet outages, or failures of third-party infrastructure providers.

CoMeety will make reasonable efforts to restore functionality and communicate updates promptly in such events.

18.8. Notices & Communications

All notices shall be given in accordance with §16 (Contact, Notices & Communication Channels).

Electronic communications (email, in-app, push notifications) satisfy any legal requirement for written notice unless a specific form is required by law.

18.9. Governing Language

These Terms are drafted in English. Where translations exist, the English version prevails in case of inconsistency.

18.10. Survival

The following provisions survive termination or expiration of this Agreement: §§3 and 6–18, as applicable, together with any rights or obligations that by their nature must continue after termination.

18.11. Interpretation

For interpretation purposes:

 

“Including” means “including without limitation.”

 

“Or” is inclusive (not exclusive).

 

Singular terms include the plural and vice versa.

 

References to “laws” include all amendments and successor regulations.

18.12. Relationship of the Parties

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and CoMeety. Each Party acts independently and bears sole responsibility for its actions.

18.13. Public Policy & Export Control

You agree not to use or export the Services in violation of applicable export control, sanctions, or trade laws (e.g., EU, UK, US OFAC). CoMeety may restrict access where required by such regulations.

18.14. Equitable Relief

CoMeety may seek injunctive or equitable relief (including specific performance) in any court of competent jurisdiction to prevent actual or threatened violations of human - intellectual property rights or confidentiality obligations.

18.15. Headings & Formatting

Section and paragraph headings are for organizational clarity only and shall not affect interpretation or enforceability.

18.16. Non-Exclusivity of Remedies

All remedies under these Terms are cumulative and not exclusive of other remedies available in equity or law.

19. Artificial Intelligence Features, Content & Responsible Use

19.1. Scope and Relationship with Existing Terms

CoMeety may provide artificial-intelligence and automated features that assist users in creating, editing, summarizing, translating, organizing, or reviewing content, including ideas, articles, guides, surveys, petitions, activity etc. descriptions, community materials, and similar content. This Section supplements, and does not replace, the rules in §§4, 6, 7, 12, and 17. AI-Assisted Content remains subject to the same conduct, intellectual-property, privacy, moderation, safety, and enforcement requirements that apply to other User Content.

Nothing in this Section permits conduct prohibited elsewhere in these Terms, the Community Guidelines, Additional Terms, or applicable law. Where a specific AI feature displays additional conditions before use, those conditions form Additional Terms for that feature in accordance with §§1.5 and 5.9.

19.2. Definitions

“AI Feature” means a feature made available through the Services that uses an artificial-intelligence model or automated system, whether operated by CoMeety or by a service provider acting for CoMeety.

“Input” means any prompt, instruction, text, image, audio, video, file, dataset, reference material, personal data, or other content submitted to an AI Feature.

“Output” means any listing, text, image, audio, video, suggestion, summary, draft, response, classification, or other material generated or returned by an AI Feature in response to an Input or user interaction.

“AI-Assisted Content” means an Output that a user selects, edits, saves, publishes, shares, distributes, relies upon, or otherwise uses through or outside the Services.

19.3. Ownership and Permitted Use of Inputs

You retain any ownership and intellectual-property rights that you lawfully hold in your Input. You grant CoMeety, its affiliates, and its authorized service providers a non-exclusive, worldwide, royalty-free licence to host, reproduce, transmit, format, analyze, and otherwise process the Input only as reasonably necessary to provide the requested AI Feature, maintain security, prevent misuse, comply with law, resolve disputes, and perform any additional use that has been clearly disclosed and is supported by an applicable legal basis.

You represent and warrant that you have the rights, permissions, authority, and lawful basis necessary to submit and process each Input. Submitting material to an AI Feature does not transfer to you any right belonging to another person.

19.4. Rights in Outputs

As between you and CoMeety, and subject to applicable law, third-party rights, and these Terms, you may use, reproduce, adapt, save, and publish an Output generated for you through the Services for lawful purposes. To the extent CoMeety acquires any transferable intellectual-property right in that Output, CoMeety assigns that right to you when the Output is generated.

This permission and assignment do not transfer any right in CoMeety’s software, AI models, system instructions, confidential methods, templates, interfaces, designs, trademarks, datasets, safety mechanisms, or other pre-existing materials. They also do not transfer rights in third-party materials that may appear in, be referenced by, or be substantially reproduced in an Output.

19.5. No Guarantee of Copyright, Exclusivity, or Originality

The legal protection available for AI-generated material may depend on the nature and extent of human creative contribution and the law of the relevant jurisdiction. CoMeety does not represent or guarantee that an Output:

(a) qualifies for copyright, patent, design, database, trade-secret, or other intellectual-property protection;

(b) is unique or exclusive to you;

(c) has not been, or will not be, generated in a similar or identical form for another user;

(d) is free from third-party copyright, trademark, privacy, publicity, personality, confidentiality, database, contractual, or other rights;

(e) is suitable for registration, commercial exploitation, publication, licensing, or enforcement against another person; or

(f) accurately reflects the style, authorship, identity, approval, or endorsement of any person or organization.

19.6. AI-Assisted Content as User Content and User Responsibility

An Output becomes User Content for the purposes of §6 when you save, publish, share, distribute, or otherwise make it available through the Services. The licence granted to CoMeety under §6.2 and the warranties in §6.3 then apply to that AI-Assisted Content.

Outputs are drafts and must not be treated as verified facts, professional advice, official records, completed publications, genuine public support, or CoMeety endorsements. Before using an Output, you must reasonably review it for accuracy, lawfulness, originality, attribution, permissions, privacy, safety, suitability, and compliance with these Terms. You remain responsible for the AI-Assisted Content you use or publish, including its claims, citations, quotations, signatures, images, statistics, instructions, and representations. Even if the content published is generated by support of AI with or without user intervention, still the entire responsibility belongs to the user who published the content and will be treated accordingly in CoMeety reviews.

19.7. AI-Specific Prohibited Conduct

In addition to §4.2, you must not use, attempt to use, or assist another person to use an AI Feature to:

(a) infringe or misappropriate intellectual-property, privacy, publicity, personality, confidentiality, database, contractual, or other rights;

(b) submit personal data, confidential information, trade secrets, private communications, access credentials, or images or recordings of another person without appropriate authority, permission, and a lawful basis;

(c) impersonate a person or organization, create a misleading digital replica, fabricate an endorsement, or falsely represent that content was created, approved, signed, supported, or published by another person;

(d) fabricate or simulate petition signatures, supporters, votes, survey responses, activity attendance, testimonials, reviews, evidence, citations, quotations, research findings, statistics, credentials, qualifications, or official records;

(e) generate or distribute misinforming, fraudulent, defamatory, deceptive, unlawfully discriminatory, exploitative, violent, sexually exploitative, or otherwise unlawful material;

(f) generate malicious code, phishing material, credential-stealing content, instructions intended to bypass security, or content intended to facilitate unauthorized access, fraud, or cyber abuse;

(g) bypass safety protections, usage limits, access controls, content filters, geographic restrictions, or other technical safeguards;

(h) discover, extract, reproduce, reverse engineer, or infer confidential system instructions, model parameters, protected training data, security mechanisms, source code, or non-public technical information;

(i) use automated methods to generate, publish, or distribute excessive, repetitive, duplicative, misleading, or spam content;

(j) manipulate CoMeety’s moderation, reporting, ranking, recommendation, voting, survey, petition, badge, verification, or enforcement systems;

(k) infer sensitive or highly sensitive information about another person, or classify, rank, target, or discriminate against a person based on protected or sensitive characteristics, where such processing is unlawful;

(l) create content that falsely appears to be professional medical, legal, psychological, financial, safety, emergency, or other regulated advice;

(m) remove, conceal, falsify, or materially interfere with a legally required AI disclosure, provenance indicator, watermark, metadata marker, or authenticity signal; or

(n) engage in a practice prohibited by applicable artificial-intelligence law, including unlawful manipulation, exploitation of vulnerability, social scoring, biometric categorization, or other prohibited use.

CoMeety may refuse to generate an Output, apply usage limits, require verification, preserve relevant records, label or remove AI-Assisted Content, restrict an AI Feature, or take enforcement action under §§7 and 15 where it reasonably believes that an AI Feature has been misused.

19.8. Factual Claims, Sources, and Citations

AI-generated references, quotations, citations, links, statistics, names, dates, legal provisions, medical information, scientific findings, and other factual claims may be incomplete, outdated, incorrectly attributed, or fabricated. Before publishing or relying on such material, you must verify it against reliable primary or authoritative sources. Even if the content published is generated by support of AI with or without user intervention, still the entire responsibility belongs to the user who published the content and will be treated accordingly in CoMeety reviews.

CoMeety may display sources, confidence notices, warnings, or verification prompts, but does not guarantee that a displayed source supports an Output or that an AI-generated factual statement is correct. You must not knowingly publish fabricated citations, invented quotations, manipulated evidence, or materially false factual claims. 

19.9. Transparency, Labelling, and Synthetic Content

CoMeety will provide the disclosures and technical measures required by applicable law, including Regulation (EU) 2024/1689, where an AI system directly interacts with a user or generates or materially manipulates text, image, audio, or video content. Depending on the feature and CoMeety’s legal role, this may include visible notices, machine-readable markings, provenance information, detection-support measures, or other technically feasible indicators.

Where an Output is labelled or marked as AI-generated or AI-assisted, you must preserve that disclosure when publishing or distributing the Output where required by law or reasonably necessary to prevent deception. Deepfakes and AI-generated or manipulated text published for the purpose of informing the public on matters of public interest remain subject to §6.15 and the applicable disclosure obligations. Artistic, satirical, fictional, or analogous content remains subject to the legally applicable form of disclosure.

CoMeety may use recognized codes of practice, technical standards, interoperable provenance methods, or EU labelling icons as compliance tools. Use of a particular tool or icon does not by itself constitute a guarantee of legal compliance.

19.10. Third-Party AI Services

CoMeety may use third-party AI models, hosting infrastructure, retrieval systems, safety tools, or other service providers to process Inputs and generate Outputs. Such providers are subject to appropriate contractual, confidentiality, security, data-protection, and international-transfer safeguards as described in the Privacy Policy and §17.

Where required by law, the relevant AI Feature or Privacy Policy will identify material information about provider processing, including the categories of data processed, purposes, retention, international transfers, and whether Inputs or Outputs may be used for provider model improvement. Provider-specific restrictions clearly presented before use may form Additional Terms for that feature.

19.11. Personal Data and Sensitive Information in AI Features

Do not submit personal data that is unnecessary for the requested purpose. Unless an AI Feature expressly states that it is designed and legally supported for such processing, you must not submit special-category personal data, highly sensitive information, precise location histories, identity documents, financial credentials, health records, biometric data, private communications, or confidential information belonging to another person.

The Privacy Policy and any feature-specific notice will describe whether Inputs and Outputs are stored, the applicable retention period, whether authorized personnel may review them, which providers receive them, whether they are transferred outside the EEA, and how available deletion or access controls operate. Prompt histories and uploaded files are retained only in accordance with §8.6, §17.12, and the applicable notice.

19.12. Model Improvement, Training, and Evaluation

The use of Inputs, Outputs, or User Content for model improvement, training, fine-tuning, evaluation, safety testing, or quality review is governed by §6.16, §17, and the Privacy Policy. CoMeety will not treat encrypted or pseudonymized data as anonymous where it remains reasonably linkable to a person.

CoMeety will not authorize a third-party AI provider to use identifiable Inputs or Outputs to train a general-purpose model unless that use has been clearly disclosed, is supported by an applicable legal basis, and includes any consent, objection right, opt-out, or other choice required by law. Where CoMeety develops or fine-tunes a model using personal data, it will apply purpose limitation, data minimization, source assessment, accuracy controls, security measures, retention limits, and any required data-protection impact assessment.

19.13. Automated Decisions and Human Review

AI Features may assist with recommendations, moderation, safety, fraud prevention, search, categorization, and personalization. The safeguards in §§7.4, 7.5, 12.4, 12.16, and 17.9 apply to automated processing and decisions.

Where GDPR Article 22, the Digital Services Act, or another applicable law requires it, CoMeety will provide meaningful information about the use and significance of automated processing and an effective opportunity to obtain human intervention, express a point of view, and contest an eligible decision. A decision that produces legal effects or similarly significant effects will not be based solely on automated processing unless a lawful condition and the required safeguards apply.

19.14. Text and Data Mining, Scraping, and AI Training by Third Parties

Except where expressly authorized in writing or permitted by mandatory law, third parties may not scrape, crawl, extract, reproduce, download, or use CoMeety Materials, the Services, or non-public User Content to train, fine-tune, evaluate, benchmark, ground, or improve an artificial-intelligence model or dataset. This restriction supplements §10.4.

CoMeety reserves all text-and-data-mining rights that it lawfully controls in CoMeety Materials, including the reservation contemplated by Article 4(3) of Directive (EU) 2019/790, and may express that reservation through machine-readable means. CoMeety does not claim ownership of User Content merely because it is processed through the Services. Any reservation or permission relating to rights retained by a user remains subject to that user’s rights, the licence granted under §6.2, and applicable law.

19.15. Surveys, Petitions, and Public-Interest Content

An AI Feature may assist with drafting or organizing the wording of a survey, petition, guide, article, or other public-interest content where that activity is otherwise permitted by §4.2, the Community Guidelines, and applicable law. AI assistance must not be used to create the false appearance of public support, participation, expertise, evidence, or consensus.

AI must not generate, cast, or simulate survey responses, votes, petition signatures, supporters, endorsements, or attendance records. Nothing in this Section permits political campaign activity or election influence prohibited by §4.2(m). If CoMeety later permits paid political advertising or regulated political promotion, separate Additional Terms and legally required transparency, sponsor, targeting, and recordkeeping measures will apply before that feature is activated.

19.16. AI Governance, Risk Management, and Compliance Roles

CoMeety will assess its role for each AI Feature under applicable law, including whether it acts as a provider, deployer, downstream provider, controller, processor, or joint controller. The legal role may differ by feature and may change when a model, intended purpose, provider, or level of control changes.

CoMeety will maintain governance measures appropriate to the nature and risk of its AI Features and its legal obligations. These measures may include an AI-system inventory, provider and vendor due diligence, contractual controls, data-protection and fundamental-rights assessments, output and bias testing, copyright and data-provenance records, security testing, human-oversight procedures, incident response, complaint handling, model-change review, and documentation sufficient to demonstrate compliance.

These governance measures do not constitute a warranty that an AI Feature will be error-free, unbiased, uninterrupted, or suitable for every purpose.

19.17. AI Literacy and Human Oversight

CoMeety will take proportionate measures to ensure an appropriate level of AI literacy among personnel and other persons operating AI systems on its behalf, taking account of their role, knowledge, experience, the context of use, and the persons affected. Training and guidance may address safe prompting, privacy, sensitive data, copyright, source verification, bias, discrimination, synthetic media, human review, incident escalation, and user complaints.

Users remain responsible for exercising appropriate judgement and oversight when using an AI Feature and must not present an unreviewed Output as verified, authoritative, or independently created by a human where that representation would be misleading.

19.18. Complaints, Intellectual-Property Notices, and Redress

You may report AI misuse, misleading synthetic content, suspected infringement, privacy concerns, or an eligible automated decision through ReportHub or support@comeety.app. Intellectual-property notices and counter-notices are handled under §§6.6 and 6.12. Moderation appeals and legally required human review are handled under §§7.5, 7.15, and 17.9.

CoMeety may request information reasonably necessary to investigate the report and may preserve relevant Inputs, Outputs, logs, labels, and account records in accordance with §§8.6 and 17.12. Reports and complaints must not be knowingly false, abusive, or submitted to harass another person.

19.19. Changes, Suspension, and Survival

AI models, providers, capabilities, limitations, safeguards, and Outputs may change over time. CoMeety may replace, update, suspend, restrict, or discontinue an AI Feature where reasonably necessary for security, quality, legal compliance, provider availability, responsible use, or the management of material risk, subject to §§5 and 11 and any mandatory consumer rights.

The provisions of this Section concerning ownership, licences, responsibility for published content, prohibited conduct, confidentiality, intellectual-property protection, preservation, and dispute resolution survive termination to the extent necessary to give them effect.
